� �ASEMGtiT <br /> This easement is cnnred subject to and conditioned upon the followine terms, conditions and <br /> covenants: <br /> i. Grantor shail at a(I times conduct its activities and all other activities conducted on <br /> Grantor's property so as not to interfere with, obstruct or endanger the usefulness of any <br /> improvements, or other facilities, now or hereafter maintained upon �he easement, or in any <br /> way interfere with, obstruct or endanger the City's use of the easement. <br /> 2. Prior ro any construction, work or any other activiry by Grantor within the easement. <br /> notification and plans for the same shall be submitted in writing to the City by Grantor and no <br /> such construction, work or activity by Grantor shall be commenced without Ciry's prior <br /> written agreement that the Grantor's proposed cons[ruction, work ur activity will not inrerfere <br /> with the Ciry's easement �ranted herein; PROVIDED, HO«EVER, any changes or revisions <br /> in d�e plans shall also be subject to Ciry's prior agreement. The City's revie�v of the Granror's <br /> plans under this easement shall not be deemed to impose any duty or obliea[ion on the City to <br /> determine the adequacy or sufficiency of Grancor's plans and designs nor whether Grantor's <br /> construction, work or activity is in conformance with other applicable plans, codes and <br /> reeulations. Further, agreement by the City to such construc[ion, work or activity shall no[ in <br /> any manner be cousidered as imposin, any obligation, dun� or liabiliry upon the City as to the <br /> safery or propriery of such construction, work or activit��. <br /> 3. Grantor hereby authorizes Ciry to cut, trim and remove any and all brush, trees, <br /> other vegetation or debris upon the easement and the ri_ht of access for such purposes. <br /> Grantor also authorizes the City to cut, trim and remove any and all brush, trees, other <br /> ��eeetation and debris on Grantor's properry which, in the Ciry's reasonable jud�ment, <br /> constitutes a hazard to the easement and the rieht of access for such purposes. <br /> , <br /> AF � O �� �� � 31 '70726 ��. <br />
