EASE�IENT <br /> 4. The Grantor aerees that title co all brush, [rees, other vegetation or debris trirnmed, <br /> cut and removed from t. easement pursuant to this Agreement, and also all brush, trees, <br /> other ve�etation or debris trimmed, cut and removed from Grantor's land pursuan[ to this <br /> Aereemen[ is vested in the Ciry, and that the consideration paid for conveyine said easement <br /> and rights herein described is accepted as full compensation for all damages incidenral to the <br /> exercise of any of said rights. <br /> 5. In d�e event Grantor places any improvements on or in the easement or constructs <br /> anything within the easement without first having obtained the written approval of the City <br /> Eneineer, the Grantor shall cease all such activiry and remove any and all improvemen[s <br /> placed therein without the �vritten agreement of the Ciry Engineer. In the event Grantor fails <br /> to obtain prior approval, Grantor hereby authorizes the Ciq� to remove any and all <br /> improvements placed or constructed therein and hold the Ciry, its officers, employees and <br /> agents harmless Prom damage caused to said improvements from remo��al diereof. Gran[or <br /> further agrees to pay the Ciry for any and all costs incurred by the Ciq� in removing the <br /> improvements. This ri�ht is in addition ro any other ri�ht the Cin� may have at law or in <br /> equiq�. <br /> 6. Grantor docs release, indemnif�}� and promise to defend and save harmless the City, <br /> its officers, employees and agents from and against any and ail liability, loss, damage, <br /> expense, actions and claims, inciudine costs and reasonable attorney's fees incurred by the <br /> Ciry, its officers, employees and aeents in defense thereof, asserting or arising direcdy or <br /> indirecdy on account of or out of Grantor's use or activiry within the above-described <br /> easement. This paragraph does not purpoR to indemnify the Ciry aeainst liabiliry for damaees <br /> arisin; out of bodily injury to persons or damages to propetty caused by or resulting from the <br /> sole necligence of the Ciry, its officers, employees and agents; provi�ed, that if the claims or <br /> 3 <br /> AF2Ua� � t� � 17U728 �� <br />
