Apparently Mr. Welliver noticed upon returning <br />from work one day that his property which abutts the gully <br />area in Eastmont had suffered an erosion from the bank. <br />As Mr. Welliver had only recently purchased the property he <br />became quite concerned about this and had a civil engineer <br />out to render an opinion as to the cause of the problem. <br />The civil engineer informed Mr. Welliver that the erosion <br />had been caused by water running over the property but was <br />at a loss to explain where the water came from. <br />Mr. Welliver noticed no further problems with the <br />erosion or with water run-off in that area. On August 18, <br />1983 Mr. Welliver was at his home when he heard an unusual <br />amount of noise on the street. Mr. Welliver noticed that <br />a City of Everett Water Department truck was out in front of <br />his home and that a hose or pipeline had been laid across <br />his property and running out to the back of the gully. The <br />water main was being flushed out at this point and the water <br />was rushing over the back of his property and into the gully. <br />At this point Mr. Welliver approached the City of Everett <br />employee, an individual identified by a name badge on his <br />coveralls as "Sterling". Scott expressed some dissatisfaction <br />with those arrangements for draining the water main and during <br />the conversation was informed that the City of Everett had <br />been doing this for a number of years but to date there had <br />been no problems, with the exception of the previous draining <br />which was done with the usual care and it caused the erosion. <br />.� <br />r <br />� <br />� <br />
