Mr. <br />Welliver became somewhat concerned about that practice and <br />initially contacted Ken Sprecher, a dispatcher or supervisor <br />with the water department and was advised that the water <br />department would make other arrangements, such as having a <br />tank truck availaUle to haul the excess water or whatever. <br />This lettnr is an attempt by us to receive assurances <br />that this activit;� by the City of Everett will be discontinued. <br />It is of a great �oncern to Mr. Welliver that if the present <br />practice by the w:ter department continues the erosion will <br />likewise continue. In the event that the flushing of the <br />water mains continues in this matter, it is probable that <br />further erosion will occur. As this happens the lateral <br />support of Mr. Welliver's property will be lost, should the <br />erosion be across a public right-of-way, or, in the alternative <br />Mr. Welliver will have a portion of his property eroded away. <br />Neither of these consequences is desired and it would appear <br />that this would be a negligent taking of the property giving <br />rise to a lawsuit for inverse condemnation.
