NOTICE OF CITY ACTION <br />PLANNING DIRECTOR DETERMINATION <br />II.B. #8-94 <br />Dear Citizen: <br />As an o�mer of property within 300 feet of 49XX Narbcck Avcnue, the City of Evcrett Zoning Codc <br />rcquires you to bc notificd of thc follo«•ing action: <br />The City of Everett Planning Director GRANTS approval of a request by Mitchell Davis to use the <br />25 foot bu(ter area from t4�e top of bank on Lot 5 as a back yard area including decking, rockeries, <br />and a driveway turnaround as shown on the approved site plan and with the following conditions: <br />Provide a pecmanent fence along the top of bank. The fence must be a minimum hcight of 42". <br />Solid board, post and rail, chain link, pickct fence, or other type of fence that is acceptable to the <br />Planning Dcpartmcnt shall bc used. Post a"EnvironmcnG111y Scnsitivc Arca" sign on this fence. <br />2. Providc a recordal covcnant protecting thc slope. <br />Comply with thc recommcndations of thc August 29, 1983 David Nclson and Associates, Inc. <br />gcotechnicalreport. <br />4. Revege[ate the cntire buffcr with groundcover or shrubs other than thc areas uscd for the dcck or <br />drivcway. <br />5. Plant vegetation in fron[ or on top of the proposed rockcry within the front sctback. <br />Section 37.140.B.7 of the City of Everett Zoning Codc rcquims a 25 foot buffcr from thc top of bank. <br />Mitch Davis proposes to construct a singlc £amily residence with a building footprint of approsimately <br />2,436 square feet on Lot 5 of Triada Granada, just soud� of 4938 Narbeck Avenuc. Lot � is approsimately <br />30,000 square fect in sizc of �chich approximatefy 22,750 square feet is considered environmentallv <br />sensitive. Thc 25 foot buffer has becn strippcd of all vcgetation. Rockeries up to 4 fcct high n�ill be placed <br />within the buffcr and the building setbacks. <br />Section 42.IOO.B of the zoning codc, using Revicw Process II.B; authorizcs thc Planning Dircctor to <br />"....approvc, disapprovc or approvc �vith conditions the use proposed by the applicant" (Subsection <br />42.IOO.B), The Planning Director approvcd the above proposal based on Section 37.050 �vhich allows <br />modification to requiremcnts of thc environmcntally sensitive areas ordinancc if thc following criteria arc <br />mct: <br />1. There is no other reasonable use or alternative to the proposed development with less impact <br />upon the environmentally sensitive area. The R-S zoning allows for a single family residence <br />upon Lot 5, which is the least intense "rcasonable" land use for this property. The propoxd <br />residence is a reasonable size relative to surrounding development. <br />To create a back yard without encroachin� into the buffer area, the proposcd residence �could <br />need to be moved to�vards the strcet. Howevcr, the proposed residence c.vuiot be moved forn�ard <br />without increasing thc stecpness of the drivc��ay. <br />
