2. The proposed development dces not pose a threat to the public health, safety and welfare on <br />or ofT of the subject lot. The proposed residence wil( be designed and built in accordance with the <br />recommendations of the David Nelson Geotechnical Report (dated August 29, 1983). The buffer <br />arca has already been stripped of vegetation. <br />3. Any alterafions permitted to the requirement of this Ordinance shall be the minimum <br />necessary to sllow for reasonable use of the property. Thcrc will be no further alterations to <br />t6e remaining environmcntally sensitive area. It appears that alt other lots along the «�est side of <br />Nazbeck Avenue within this subdivision have developcd the 25 foot buffer into back yard space. <br />4. The inability of the applicant to derive reasonable economic use of the property is not the <br />result of actions by the applicant in subdividing the property or adjusting a boundary line, <br />thereby creating the undevelopable condition after the etfective date of this Ordinance. This <br />is an e+usting platted lot created in 1984. The Ordinance did not become effective until 1990. <br />The proposal mitiPates t6e impacts on the environmentally sensitive areas to the mazimum <br />eztent possible. There will be no furthcr impact on the slopc. The 25 foot buffcr will primarily be <br />replanted with lawn and omamental shrubs. The driveway tumaround and deck will setback 1� <br />feet &om the top of bank. A fence will be placed at the top of bank to demarcate the boundary of <br />the environmentally sensitive area. <br />The applicant or an owner of property located within 300 feet of the subject properh• may appeal the <br />Planning Director's dctertnination as to �vhether to allow the proposed site improvements. My such appeal <br />must be filed within ten (10) calee�dar days of the date specified below. Appcal forms are availablc from <br />the Planning Departmcnt and must be filed with the required 61ing fec.
