Box C97055 RETURN RECEIPT REQUESTED CITY OF <br /> Redmond, WA 98072 <br /> eve rett <br /> RE: Zoning Code Violations on vacant parcel known as F022804-1-002 CITY HALL • 259-8755 <br /> EVERETT.WASHINGTON <br /> 98201 <br /> Dear Mr. Welcome: <br /> On or about June 27, 1990 you were ordered to STOP WORK on the subject property <br /> because you had cut and notched several trees beyond the boundaries of Public Works <br /> Permit #90-193. <br /> The cutting of these trees in an environmentally sensitive area violates several <br /> sections of the Everett Zoning Code. Specifically, these sections are: <br /> 37.160 Development Activity and Improvements in or Near a Stream, Lake or <br /> Wetland. <br /> 1. General. No development activity may take place, nor may any <br /> improvements be located in a stream, lake or wetland except as <br /> specifically provided in this Subsection or as otherwise permitted or <br /> required under the Shoreline Master Program. In addition to the <br /> requirements of this Subsection, the applicant shall obtain all <br /> necessary State and Federal permits. <br /> 2. Rehabilitation. The City may permit or require the applicant to <br /> rehabilitate and maintain a stream, lake or wetland by removing <br /> debris, sediment, vegetation, or other material detrimental to the <br /> area, replanting disturbed vegetation, or by other methods deemed <br /> appropriate by the Planning Director. Rehabilitation may be required <br /> at any time that a condition detrimental to water quality or habitat <br /> exists. <br /> The enforcement provisions which are detailed in Section 37.200 are as follows: <br /> B. Any person, firm, corporation, or association or any agent thereof who <br /> violates any of the provisions of this Section shall be guilty of a <br /> misdemeanor punishable by a fine not to exceed $1,000.00. It shall be a <br /> separate offense for each and every day or portion thereof during which any <br /> violation of any provisions of this Section is committed. <br /> C. Any person, firm, corporation, or association or any agent thereof who <br /> violates any of the provisions of this Section shall be liable for all <br /> damages to public or private property arising from such violation, including <br /> the cost of restoring the affected area to its condition prior to such <br /> violation or to such other condition acceptable to the City. <br />
