Frank Becu�ett seconded the motion. <br />Vote: Unanimous in favor of granting th,� variance. <br />ITRM 6: <br />Applicant: Robert La Grandeur <br />1213 Wetmore <br />Everett, Washington 98201 <br />Proiect Location: <br />2onin : R-1 <br />Lot 11, Plat of Nassau View Tracts <br />Variance Requested: Variance from E.M.C. 10.14.050(B), Side Yards, to allow <br />1 a zero-foot side yard on the north side where the property <br />� <br />abuts unu�ed public right-of-way. <br />Pearl Maddy suunarized the staff report (see Variance Pile No. 40-86) and <br />presented slides o£ the property. <br />Peazl reported that she had received a phone call that afternoon from the person <br />w.*.o uwns c1�e property to the north of this property. He is concerned because <br />he aas going to propose that the rest of the City ROW should be vacated. He <br />hoped th�t the vacated right-of-way would accrue to hi.^. property rather than <br />to Lot 11 since Lot 11 has already benefitted from some vacated rightrof-way. <br />However, this is a legal matter which this Hoard cannot address. In order <br />for a street vacation to occur, 75� of the abutting property owners must agree <br />to the vacation. According to the City's property manager, approximately 50 feet <br />of right-of-way abuts the property and would be eligible for vacation. About <br />20 feet of right-o:-way was vacated and accrued to the subdivision at the time <br />of subdivision. TY.is zrea is ;teep and the City has no plans for a street there. <br />Robert La Grandeur, the applicant of 1213 Wetmore, stated that this information <br />concerning a possible street vacation was new to him, and that he was not aware <br />that a previous vacation had accrued to the plat. <br />Bill Lucas of 4002 Nassau Place, who lives directly across the street, stated <br />that he has known Mz'• I.a Grandeur for many years and he would make a qood <br />neighbor. He feels the right-of-way would never be u�ed. He favors the <br />variance but he wants Mr. La Grandeur to rem_��er that 15 feet is 15 feet. <br />Burl Long, of 9100 N. Hollywood in Bremerton, the owner of Lot lE, stated <br />that he had picked up an application for a road vacation last week and he w:�ll <br />be submitting an application to vacate the northern portion of the right-of.-way. <br />
