Criterion No. 2: <br />That the variance will not be materially detrimental to the property in the <br />area of the subject property or to the City as a whole. <br />a. Findings:. The applicant has slated tliat the proposed <br />building design which incorporates larger awning and <br />rooflines is to improve the quality and design of the proposed <br />project, which is a direct benefit to the neighborhood, <br />The Board finds that the proposed structure is not out of scale <br />or character with the neighborhood and therefore the <br />proposed variance should not be detrimental to the site or <br />area as a whole. The clinic overlay established in the Zoning <br />Code is a benefit to professionals in the area and the <br />redevelopment of this site with help to improve this corner of <br />Everett. <br />b. Conclusions: The City provided written notice to all property <br />owners within 300 feet of the subject properly; no comments <br />were received. <br />The City of Everett Public Works, Fire and Building <br />Departments have had the opportunity to review the proposal; <br />their comments have been included in the Final Mitigated <br />Determination of NonSignificance, and include requirements <br />for building and public works permits. <br />Criterion No. 3: <br />That the variance will only grant the subject property the same general <br />rights enjoyed by other property in the same area and zone as the subject <br />property. <br />a. Findings: The applicant has stated that several homes and <br />apartment buildings within the neighborhood, as well as the <br />hospital, appear to be located within the required setback <br />area, and are located closer to the property line than the <br />proposed structure, Providence hospital sought several <br />variances from setbacks for the remodel and expansion that <br />occurred in 1991; these variances were approved by the <br />Hearing Examiner after a review of the project. <br />The Board finds that many structures within the immediate <br />neighborhood are in fact located within required setbacks, <br />and the encroachment of those structures is more than what <br />is proposed by the applicant. <br />b.
