Conclusions: The proposed clinic is being located on the <br />setback line to comply with current code requirements, and <br />therefore the proposed variance is not the result of a self- <br />created hardship. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett does <br />hereby order that the requested variance be APPROVED to allow for eaves <br />and awnings to encroach between three and six feet into the front setback <br />area, and three feet into the street side setback area. <br />The action of the Board of Adjustment in APPROVING a variance shall be <br />final and conclusive, unless within twenty-one (21) days from the date of <br />decision or aggrieved person or persons obtains a writ of celliorari from the <br />Superior Court of Washington for Snohomish County for the purpose of <br />review of the action taken. <br />DATED this 1 V day of September 2004. <br />Chairman, Board UAdjustment <br />Notes to Applicant: <br />If a variance is approved, building permits are required and must be <br />obtained within one year from the approval date after which the Board <br />of Adjustment's decision shall cease to be effective.
