Retaining walls located within any required building setback a-e limited to 36" in <br />height. Required setbacks for this site are twenty feet front and rear (east and <br />west property line), ten feet street side setback (southern property line), and five- <br />foot interior side setback (norther property line). <br />14. The height limit for t e site is 28 feet above base elevation. The applicant will <br />likely need to provide a filling and grading plan to the ;rty for approval prior to <br />building permit issuance. The approved grad on site will be used as the new <br />base elevation, which will be approximately elevation 185. The proposed <br />residence is permitted to be constructed 28 feet above the approved bace <br />elevation. <br />15. The applicant must record a covenant that runs with the land which wai\ es claims <br />against the City, its officers, employees and agents. and indemnifies (including <br />reasonable attorney's fees), defends and save; the City, its officers, employees <br />and agents harmless from any loss or damage to people or property Tither on or <br />off the subject property resulting from any form of soil movement wnatsoever <br />and/or from any form of failure in design and/or construction of the improvements <br />thereon whatsoever. The owners of the subject property shall provide the City <br />with the covenant and it shall be signed and acknowledged by all parties with an <br />interest in the property. Ti- covenant shall also provide notice concerning the <br />presence of uncontrollec and environmentally sensitive features on the <br />property. The covenant must be presented to the City for review and approval <br />and, upon approval, recorded by the applicant with the Snohomish County Auditor <br />prior to issuance of any permits for the site. <br />16. Compliance with all other local, state and federal codes is required. <br />APPEALS: This determination may be appealed to the Land Use Hearing Examiner. <br />Ary such appeal must be filed within 14 days of the dale specified below. Appeal forms <br />are available from the Planning Department and must be submitted along with the <br />required filing fee.
