LAND USE APPROVAL <br />PLANNING DIRECTOR DETERMINATION <br />STEEP SLOPE MODIFICATION <br />REVI #04-017 & ESA #04-012 <br />Applicant/Owner: Spencer OJ Spence <br />2720 - 210°i Street SW <br />Lynnwood, WA 98036 <br />Location: 3431 Nassau Street <br />Zoning: R-1 Single Family Detacheu Low Density <br />Project: Construction of a new single family residence on a vacant lot <br />Background: The property is zoned R-1, Single Family Detached Low Density. The site <br />appears to be contained in a depression, and does contain a steep slope area as defined <br />by the City of Everett Zoning Code. The site has been repeatedly used for the illegal <br />dumping of materials, and currently contains up to 18 feet of uncontrolled fill. The <br />applicant has retained the services of GES. Inc. to provide specific recommendations for <br />construction and earthwork to be done on the site. The findings and conclusions of this <br />land use decision are based upon the GES, Inc. report prepared by Roland D. Maynard <br />and Kirk R. Bailey, dated March 5. 2000, and updated report dated August 29, 2004. <br />Under the City of Everett's Zoning Code a setback of 25 feet is typically required from the <br />ridge or "top of bank" for projects proposed in steep slope areas. The applicant is <br />proposing to construct a new single-family residence on a vacant lot. All new structures <br />are required to meet the 25' buffer requirement or seek a modification through the City <br />Planning Department. <br />FINDINGS AND CONCLUSIONS: Section 37.040.D of the Everett Zoning Code <br />designates slopes of 40010 or greater as an environmentally sensitive feature. Section <br />37.080.E requires a 25' buffer from the top of the slope. Section 37.080 allows the <br />Planning Director to authori _e the alteration of a slope or its buffer if he approves a <br />geotechnical report which demonstrates that: <br />1. The proposed development will not create a hazard to the subject property, <br />surrounding properties or rights -of -way, erosion or sedimentation to off -site <br />properties or bodies of water; and <br />2. The proposal addresses the existing geological constraints of the site, including <br />an assessment of soils and hydrology; and <br />3. The proposed method of construction will reduce erosion potential, landslide and <br />seismic hazard potential, and will improve or not adversely affect the stability of <br />slopes; and <br />i <br />�1� <br />
