<br />THIS DECLARAT20�1, .nade on the date hereinafter set forth by

<br />ARNOLD R. HOFMANN and VICKI G. HOFMANN, husband and wife, eacn as

<br />to their undivided one-half (1/2) interest, hereinafter referred
<br />to as "Declarants."
<br />h".TNESSETH:
<br />WHEREAS, DeclaranEs are the owners of certain real property
<br />located in City of Everett, in Snohomish County, and legally
<br />described as follows:
<br />Lot 9 and Lots 23 to 28, inclusive, Block 4,
<br />Hewitt Heights Addition to Everett, according
<br />to plat thereof recorded in Volume 5 of Plats,
<br />Page 15, Records of Snohomish County, Washington.
<br />!]OW THEREFORE, Declarants hereby declare that all of the
<br />properties described above shall be held, sold and conveyed sub-
<br />ject to the following easements, restrictions, covenants, and con-
<br />ditions, which are for the purpose of protecting the value and
<br />desirability of, and which shall run with the real property, and
<br />be binding on all parties having any right, title or interest in
<br />the described properties or any part thereof, their heirs, succes-
<br />sors and assigns, and shall inure to the benefit of each owner
<br />thereof;
<br />1. Easement. There shall be an easement for water, sewer,
<br />gas, electric: power and other utilities, together with an easement
<br />for a private road across the entire Lot 9 of said abo•�e-described
<br />property and a thirty (30) foot easement across the east thirty
<br />(30) feet of Lots 23, 24, 25, snd 26 whereby the owne:s, contract
<br />purchasers, tenant or other person or persons in rightful posses-
<br />sion, of each of Lots 23 through 2G shall be entititled to access
<br />to their property for said utilities and a private road as above-
<br />described.
