,0i j <br />r. .� <br />BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 7-88 <br />Based upon the written request, for a variance from the City's zoning code by: <br />Lawrence Wicken <br />2232 Baker <br />Everett, WA 9B201 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.14.060, Height., to allow: <br />construction of a single family residence that would be 35 feet in <br />height instead of the 28 feet allowed by Code. <br />on the following described property: <br />Lots 1 through 6, Block 2, Queen Anne Addition to Everett <br />commonly known as: 16Rx Mukilteo Blvd. <br />The Board of Adjustment., following a public hearing on said application held <br />on April 4, 1988 and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />VARIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion dl: That there have been exceptional or extraordinary <br />circumstances or conditions applying to the subject <br />property or as to the intended use thereof that do not <br />apply generally to other properties in the same vicinity <br />or zone. <br />a. Finding: The Applicant wishes to construct a single family <br />residence on property which fronts on Mukilteo Boulevard south <br />of the bridge which is between Glenwood and Greeley. The site <br />is approximately 10 to 12 feet below the deck of the bridge. <br />Access to the site is via the alley on the south. The <br />Applicant wishes to build up so the living area won't be <br />looking directly at the side of the bridge and also to take <br />advantage of a partial view of the Sound from the upper floor <br />looking to the northwest. <br />b. Conclusion: There are exceptional and extraordinary <br />circumstances applying to the subject property that do not <br />apply generally to other property in the vicinity and zone. <br />Criterion 92: That such variance is necessary for the preservation and <br />enjoyment of a substantial property right of the <br />appellant possessed by the owners of other properties in <br />the same vicinity or zone. <br />a. Finding: There are other properties in this zone that have a <br />view of the Sound, and since the height limitation in this zone <br />was recently changed from 35 feet in height to 28 feet in <br />height, there are other homes in the zone that are 35 feet in <br />height.. <br />b. Conclusion: The variance is necessary to allow the Applicant a <br />property right possessed by others in this vicinity and zone. <br />
