_. __ ______ _ I <br />Marjorie Carlson <br />Short Subdi�ision Variance 30-89 <br />Page —4— <br />CONCLUSIONS <br />1• The application is for the approval of a variance from the lot width <br />atandarde of proposed lot 02 wuich is part of a four-1ot ahoet <br />aubdivieion to be developed at 2129 Mukilteo Boulevard, Everett, <br />Waehington. In particular, the requested variance is for a reductioa of <br />the 80 foot lot width standard to a lot width of 64 feet. <br />Z• In order for a variance to be granted, the criteria of the Everett <br />Hunicipal Code (EMC) and the Subdiviaion Ordinance (Section 6.A.5(a—c)) <br />muat be satiefied. With conditione, theae criteria are eatiafied. <br />3. Special circumetances eaiat for the grant of the variance. The special <br />circumatancea include the ateep topography and environmentally aeneitive <br />nature of the weetern portion of the property that limite the area of <br />the ahort plat that can be developed. In addition, the reteatioa of an <br />eaieting single family home on lot N4 neceeeitates an irregular shape of <br />the property (proposed lot 92) which reeulta in the reduced lot Xtdth. <br />These conetitute special circumstancee for the grant of the variance. <br />4• The grant of the variance will not be detrimental to the pubiic welfare <br />nor injurioue to the propertq in the vicinitq or zone in which the <br />property is to be located. Adequate area for development can occur on <br />the eaetern portion of proposed lot �2. <br />5. A hardehip �rtll be incurred by the Applicant if required to comply with <br />the atrict application of the sectione identified. The hardehip aill be <br />the denial of the right to develop a 23,000 square .f�ot lot ia a manaer <br />conaiateat with other propertiea in the area. <br />b• The Everett Nearing Examiner hae juriedictional authority to hold thie <br />hearing and to issue a deciaion. <br />DECISION <br />Hased upon the preceding Findings of Facta and Concluaiona, the testimoay and <br />evideace submitted at the public hearing, and upon the impreeaionu of the <br />Everett Hearing Eaaminer of the site viex, it ie hereby ordered that a <br />variance ie granted to the Applicant for the develq�meat of proposed lot 42 of <br />a four—lot short subdivision at 2129 Mukilteo Boulevard, Everett, Waehiagton. <br />The variaace ie granted eubject to the following conditiona: <br />1• The deaign of the four—lot ehort subdiviaio¢ remain the same as <br />aubmitted in ezhibit d3. <br />2• The mid—poiat measuremeat for the lot Width of lot N2 aot be lesa ehan <br />64 feet. <br />
