Becktell <br />2414 Hukilteo Boulevard <br />Everett, HA 98203 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />79•12.050(B), Sldeyard, to allow: a three foot side yatd setback instead of <br />the seven and one—half feet required by City Code. <br />on the folloaing described property <br />4test 100 ft. of Lot 2, Block 3, Plat of Darlington <br />commonly known as: 2414 Mukilteo Blvd. <br />The Board of Ad�ustment, following a public hearing on said application held <br />on August 3. 1987 and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />YARIANCE CRITERIA: <br />FSndinBs and Conelusions: <br />Criterion it: <br />That there have <br />circumstances or <br />property or as to <br />apply generally to <br />or zone, <br />been exceptional or extraordinary <br />conditions applying to the subject <br />the intepded use thereof that do not <br />other properties in the same vicinity <br />a. Finding: This is an older home, built in 19z8 prior Lo the <br />Zoning Code. It has had several additions, most recently in <br />June 1982. The lot has adequate square footage, but the <br />plaeement of the existing house on the lot requires that the <br />proposed garage be accessed by the existing gravel driveway <br />abutting the east property line. <br />b. Conclusion: If Lhe site was vacant, thete would be ample room <br />to lay out the buildings within the required setback; however, <br />the fact of the location oF the existing houae is the <br />exceptional cirewostance that necessitates the request for <br />vari��nce. <br />Criterion p2: That sueh variance is neces�ary for the preservation and <br />enjoyment of a substantial property right of the <br />appellant possessed by the owners of other properties in <br />the same vicinity or zone. <br />a.
