Becktell <br />2414 Mukilteo Boulevard <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant,^ for a variance from E.M.C. <br />19.72.050(B), Sideyard, to allow: a three foot side yard setback instead of <br />the seven and one—half feet required by Clty Code. <br />on the folloWing described property <br />Hest 100 ft. of Lot 2; Block 3r Plat of Darlington <br />commonly known as: 2414 Mukilteo Blvd. <br />The Board of Adjustment, following a publie heating on sald appllcation held <br />on August 3, 1987 and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />VANIANCE CRITERIA: <br />Findings and Conelusions: <br />Criterfon it: That there have been exceptional or extraordinery <br />circumstances or conditions applying to the subject <br />property or as tc the intended uae thereof that do not <br />apply generally to other properties in the same vieinity <br />or zone. <br />a. Findlne: This is an oldet home, built in 1928 prior to the <br />Zoning Code, It ha� had several edditlons, mosb recently in <br />�! dune 1g82. The lot has adequate aquare fcotage, but the <br />' placement of the existing houae on the lot requites that the <br />proposed garage be accessed by Lhe existing gravel driveway <br />ebutEing Lhe exst property line. <br />b. Conelusions If the site was vacant, there would be ample room <br />to lay out the buildings within the required setback; however, <br />the faet of the location of Lhe exlsting house is the <br />exceptional circumstance that necessitete� the request for <br />variance. <br />Criterion 12: That such variance is necessary for the preservation and <br />enjoyment of a substantlal property rlght of the <br />appellant possessed by the owne�s of other propertiea in <br />the same viclnity or zone. <br />a.
