<br /> Based on the infcrmation that was submitted by the neN oWner's (Dick Mauleby)
<br /> repreeentative when they applled for a variance for front eetback for the
<br /> subject lote on March 17, 1988 (see at.tached site map), there Se enough lot
<br /> area remaluing (12,300 square feet) even if the new eurvey is correct and
<br /> there ie only 120 feet of lot depth inetead of 128 feet. �/
<br /> Pearl hae talked to Mr. Mauleby and it appeare that we�are being aeked to
<br /> intervene in a private property matter, since Mr. Ma eby aaqe hie legal
<br /> deecriptian le for the south 128 feet of Lote 6 and 7, Block 15, Plat of
<br /> Pinehuret, and he hae aeked Mr. Armietad to move hie fence eight feet to the
<br /> north eo he will have hie 128 feet.
<br /> Pearl has also talked to Craig Fullertan and Larry Craxford and theq are not
<br /> eupportive of a partial etreet vacation eince Council hae aa eetabliehed a
<br /> policq of not granting partial vacatione of street righ[-of-xay.
<br /> In addition, iu order to vacate public right-of�ray, two-thirde of the
<br /> abutting property ownere must eign a requeat for vacation. Thia procedure hae
<br /> been coomunicated to Mr. Maulsby, so he ie aware that he Would need to
<br /> initiate the proceee if he wishee to pureue the poeeibilitq of a vacation.
<br /> Mr. Maulebq's concern appeare to be that the etructure and parking he wiehee
<br /> r.o build w111 onlq fit on a 128 foat deep lor with the variance for froat

<br /> conet�uction as shoxn on the atrached aite plan, leaving the ferce where it
