Because the cost of remediation exceeds the note balance due the <br /> Seller, the couR has ordered that tha Seller must release the deed to us under the terms of <br /> lhe indemnificalion Gause of our Purchase and Sale Agreement. <br /> In additlon, the Seller was not able to provide a pian, which would be more cost effedive <br /> than the plan we have proposed. We are now free to proceed with the clean up of the site, <br /> under the gufdelines,which we have previously, discussed with you. <br /> It wiil take approximately two weeks to have ihe proper documentation to satisfy the title <br /> company and our lenders. We anticipate having the clean up contractor back on sita in <br /> approximately three to four weeks, at which time the clean up oF the site will resume. <br /> We have just recently compieted our negotiatfons with the firtns involved in lhe clean up and <br /> will �9 able to provide you with a copy oi our modified clean up plan in early December. <br /> I must express my sincere gratitude for your assistance and palience throughout this lengthy <br /> legal process.
