En��n�er�ngrPubi�c Services <br /> Dear Yir. fJ�cKee: <br /> As you are aware, our seller, also the defendant in our legal action against him, has been <br /> uti�izing any opportunity to frustrate our efforts to continue with the planned soils mitigation <br /> on the above referenced site. When last I contacted you, we had been awarded the <br /> property by the Snohomish County Superior Court at a court hearing held on November <br /> 27, 2000. <br /> The seller refused to voluntarily provide the necessary documents to clear title. We had <br /> instructed our attorney to allow the seller until December 15, 2000 to provide these <br /> documents. Subsequently, our attomey drew up a form of order for presentation to the <br /> court for the judge's signature. The judge was unavailable to hear the presentation due to <br /> the holiday break. When the judge returned to the bench after the first of the year, his <br /> calendar was filled until January 26, 2001. <br /> The selier's attomey contacted our attorney on the moming of the newiy scheduled <br /> hearing to advise us that they had no opposition to the form of order. The judge <br /> subsequently signed the order and at present, the title company is completing the transfer <br /> of title. <br /> We are finally in a position where, the seller is no longer able to delay our efforts to <br /> continue the soils mitigation. We have scheduled the cleanup contractor to retum to the <br /> site around lhe 15'"of February. I anticipate, that, the clean up could be completed by the <br /> end of March 2001. As soon as is possible, I will submit the necessary documentation to <br /> Department Of Ecology for their review and subsequent No Further Action letter. <br /> Our clean up contractor has been completely buried in other work and is trying to get a <br /> revised work plan to me for distribution. I am told that it will be available before work <br /> continues. <br /> I must express, again, my appreciation for the patience you and your agency have <br /> extended us in this extremely trying process. We have expended a considerable sum of <br /> money fighting the seller, not to mention time and effort. If you have any questions, <br /> please contact me at your earliest convenience.
