._.....Y�._...�.,�..�- <br /> ' -� , . <br /> � � <br /> Findings: Landscape Category 'C� applies to the proposed use. <br /> - There is an existing area of native vegetation located on the <br /> south property line, between the site and Marine View Drive. This <br /> vegetation provides a buffer between the site and existing <br /> residences on the south side of Marine View Drive. The Planning <br /> Director has waived the landscaping requirements under the <br /> authority of Subsection 35.070.A of the Zoning code. <br /> Conclusions: Existing conditions on and adjacent to the site, <br /> including presence of native vegetation and topography, would <br /> render the landscaping requirements of Section 35 of the Zoning <br /> � Code ineffective. Therefore, the landscaping requirements are <br /> waived. <br /> 8. The generation of nuisance irritants such as noise, smoke, dust, <br /> odor, qlare, v�sual blight or other undesirable impacts. <br /> Findings: The proposed switchinq station would not involve use of <br /> noise-generating equipment and would not produce emissions to the <br /> air. <br /> Conclusions: No noise, smoke, dust, odor, glare, visual blight <br /> or other undesirable impacts will be created except during the <br /> construction of the project. <br /> 9. Consistency with the qoals and policies of the Everett General <br /> Plan for the area and land use designation in which the property <br /> is located. <br /> Findings: The site is designated Water-Oriented industry--Port <br /> Development on the General Plan map. There are no policies which <br /> address above ground utilities in areas with this designation. <br /> However, the Zoning Code allows above ground utilities, subject <br /> to review process II.B. <br /> Conclusions: The use is not inconsistent with the General Plan. <br /> 10. Compliance with the provisions of this Ordinance and other City, <br /> State and Federal regulations. <br /> Findinqs: The proposal has been reviewed under SEPA, with the PUD <br /> assuming lead agency status. In addition, contaminated soils on <br /> the site have been remediated. According to information provided <br /> by the applicant, remediation was complete in September 1992. <br /> The City has not received official acknowledgment from the <br /> Department of Ecology (DOE) or Health District that soil <br /> contaminant levels meet cleanup standards. <br /> Conclusions: Prior to issuance of building permits, the <br /> applicant must provide information which dncuments that soils <br /> contaminants levels do not exceed state and/or local cleanup <br /> levels. If this information is provided, the proposal wi.11 <br /> 3 <br />
