PLANNING DIRECTOR DETERMINATION <br />Review Process II #25-97 <br />INTRODUCTION: The City of Everett Planning Department received an application from <br />Tina Cobb, 2109 McDougall Ave, Everett, WA 98201 for a bedroom addition to an existing <br />single family residence located at 2109 McDougall Ave. The new addition will have the same <br />setback from the north side property line as the existing house structure of only one foot. <br />Section 38.040 allows for the Planning Director to permit the expansion of a structure which <br />does not meet required :,.etbacks or height, provided that the expansion does not make the <br />setback or height mire nonconforming; that the expansion complies with all other <br />requirements of the zonirg code ordinance; and that the nonconformity has been certified by <br />the Planning Department. <br />BACKGROUND: The property is located in the R-2, Single Family Residential Zone. The <br />typical required setbacks are 20' from the front and rear property lines and 5' from the interior <br />side property lines for a single family residence and accessory structures. The existing <br />residence is located only one foot from the north side property line. It was originally <br />constructed in 1920 according to the Snohomish County Assessors records. The zoning code <br />requirement for a minimum 5' building setback for structures from a side property line became <br />effective December 31, 1956. <br />FINDINGS: The existing residence has a one foot setback from the north side <br />property line. This structure's setback has been certified as a legal nonconforming setback <br />(NCB #19-97). The applicant proposes to add on to the residence with the same setback from <br />the north property line with no further encroachment. <br />DECISION: The Planning Director has determined to allow for the proposed addition <br />with a one foot setback from the north property line with the following conditions: <br />Necessary building permits are to be obtained from the City of Everett's Building <br />Department prior to construction. <br />Right to Appeal: The applicant or owner of property located adjacent to the subject property <br />or any property owner who deems himself aggrieved and will thereby suffer a direct impact <br />from the proposal may appeal the Planning Directors determination as to whether or not the <br />proposal should be permitted. Any such appeal must be filed within fourteen (14) calendar <br />days of the date specified below. Appeal forms are available from the Planning Department <br />and must be submitted along with the required filing fee.
