Resolution No. 3730 Dated 1/20/93 <br />All of the exhibits are available for inspection at the Hearing Examine's Office <br />located at 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the <br />Applicant, testimony and evidence elicited during the public hearing, and as the <br />result of the personal inspection of the subject property and surrounding areas <br />by the Everett Hearing Examiner, the following findings of fact and conclusions <br />constitute the basis of the decision of the Everett Hearing Examiner. <br />FINDINGS OF FACT <br />The Applicant requested approval of a Special Property Use Permit for <br />the development and operation of the Fixed Moderate Risk Waste <br />Facility on property at 3402 McDougall Avenue, Everett, Washington. <br />As part of the development, it is the intent of the Applicant to modify and <br />expand a portion of the existing commercial building on -site to <br />accommodate the Moderate Risk Waste Facility. The facility will be used <br />for activities including the collection, recycle, reuse, consolidation, <br />packaging, storage and shipping of moderate risk wastes that are ` <br />generated by households in Snohomish County. The facility will also be <br />used for the processing of small quantity generators. The site is also <br />proposed to be used by the Applicant as a vehicle maintenance facility, <br />but this use is not subject to the Special Property Use Permit because it <br />is a non -conforming use. (Exhibit 1) <br />The Applicant has conducted moderate risk waste activities at various <br />locations throughout the County. These activities have proven to be <br />successful, and it is the intent of the Applicant to use the proposed site <br />as a permanent location for drop-off services and risk waste activities. <br />(Exhibit 1, Kelly -Clark testimony) <br />3. The proposed development of the facility is part of compliance with <br />Federal and State laws and regulations. The facility is a feature of the <br />Applicant's implementation of the Resource Recovery Act of 1970 that <br />was enacted by the United States Congress (Public Law 91-512). RCW <br />Chapter 70.105 requires local jurisdictions to develop plans for improving <br />moderate risk waste management. RCW Chapter 70.105D sets forth the <br />Washington Model Toxic Control Act which provides regulatory direction <br />
