Descrintion of Violation <br />A. Retainine wall, fill. Retaining walls have been conswcted and fill material has been added <br />to the property without benefit of permits. <br />• Ordinancc number 2362-99, sec'tion 3 adopts the 1997 editions of the Uniform Building <br />Code and the Uniform Building Code Standazds, as amended by the Washington <br />Administrative Code Section 51-40, ercept some portions that have been deleted, modified <br />or amended by Chapter 16.01 of the city code. <br />• Uniform Building Code Section 103 states that it is unlawful for any person, firm or <br />corporation to erect, cons[ruct, enlarge, alter, repair, move, improve, remove, convert or <br />demolish, equip, use, occupy or maintain any building or structure or cause or permit the <br />same to be done in ��iolation of the Unifomi Buitding Code. <br />• Uniform Building Code Section 106.1 states that permits aze required unless <br />specifically eaempted by the Uniform Building Code. <br />• Uniform Building Code Section 106.2(5) specifies that only retaining walls less than <br />four feet (4 fr) in height are exempt from permits. <br />• Section 19.39.150(C)(5)(d) of the E��erett cin� code states that any rocken�, or retaining wall, <br />or structure retaining soil ��•hich is greater than thirty-six inches in height shall comply wid� <br />building setback requirements, unless approved b}• the planning dimctor. <br />�3 <br />
