Page 8 of 46 <br />C. Erosiv�tv Waiver <br />Operators may qualify for a waiver from the permit if the following conditions are met <br />1. The site will result in the disturbance of less than 5 acres; and the site is not a portion <br />of a common plan of development or sale that will disturb 5 acres or greater. <br />2. Calculation of Erosivity "R" Factor and Reg:onal Timeframe: <br />a. The project's rainfall erosivity factor ("R" Factor) must be less than 5 during the <br />period of construction activity, as calculated using the Texas A&M University <br />online rainfall erosivity calculator at: htm://ei.tamu.edu/. The period of <br />constructien activiry begins at initial earth disturbance and ends with frnal <br />stabili_ation; and, in addition: <br />b. The entirc period of construction activity must fall within the following <br />timcframes: <br />i. For sitcs west of the Cascades Crest: June ] 5— September I5; or <br />ii. For sites east of the Cascades Crest, excluding the Central Basin: June 15 — <br />October 15; or <br />iii. For sites east of the Cascades Crest. within the Central Basin*: no additional <br />timeframe restrictions apply. <br />"Note: The Central Basin is defincd as the portions of Eastem Washington <br />Hith mean annual precipitation of less than 12 inches. <br />3. Operators must submit a complete Erosivity Waiver Certification Form at least one <br />week prior to commencing land disturbing activities. Certification must include: <br />a. A statement that the operator will comply with applicable local stormwater <br />requirements; and <br />b. A staten:^nt that the operator will implement appropriate erosimt aid sediment <br />control BtiIPs to prevent violations of water qualiry standards. <br />d. This waiver is not available for facilities declared a sienificant contributor of <br />pollutants as defined in Condition S 1.B.l.b. <br />5. This waiver does not apply to construction activiry which includes non-stormwater <br />discharees listed in S I.C.3. <br />6. If construction activiry extends beyond die certified waive� period for any reason, the <br />operator shall either: <br />
