PORT OF EVERETT <br />W MAR�NE VIEW DR <br />IMPROVEMENTS <br />APPENDIX - A <br />RAIL COORDINATION AND SAFETY PROGRAM <br />CIP NO. 3-0-003-09 <br />PROJECTNO. <br />PD-WM-20006-01 <br />7his Section descri6es the requirements for rail coordination and rail safety. <br />A. BNSF Railway (BNSF) owns and operates tracks adjacent to W Marine Vew Drive. BNSF utilizes <br />these Uacks for freight service. There is no published schedule for freight service. BNSF dces not <br />guarantee the accu2cy or completeness of any published or unpublished schedules and reserves <br />the right to add, change or othenvise modify the level of activity across the tracks. <br />This Section describes the requirements for nrl coordinallon and rail sa/ety. <br />B. Contractor shail ensu�e ihat all personnel ihat will perfortn any work on the BNSF right-of-way or <br />within 25 feet of any BNSF Uacks will complete the conuactor orienta6on course available on-line <br />at www.contractororientabon.com and carty a current course completbn certificatlon card at all <br />Gmes whiie working on BNSF right-of-way or within 25 feet of any BNSF tracks. <br />C. Contractor shali comply with all requirements of Federal Railroad Administration regulatbns <br />regarding railroad wotkplace safety inciuded in Title 49, Part 214 of the Code of Fede21 <br />RegulaGons. . <br />D. BNSF requires that approved rdilroad Bagger(s) be used whenever wo�C is being conducted within <br />25 feet of the mainline track or whenever BNSF inakes a detertninafion that a flagger is required. <br />The ConUactor will be required to no6fy BNSF as appropriate based upon location whenever work <br />needs to te done within railroad rights-of-way or within 25 feet of any iracks. The final decision as <br />to ihe number and location of flsgger(s) that wili be required for the work will be made by BNSF. <br />Repeated instances where the flaggers are scheduled and no eRective wnrk occurs will be <br />considered when reviewing change order requests. <br />E. In order to assist the ConVactor to continue wo�C when no railroad flaggers a2 available, BNSF <br />may (with advance permission) pertnit the Contractor to work without flaggers if all work occurs <br />behind a temporary six-foot high chain link safety fence, located at least 12 feet from the centerli�e <br />of the active track. If no flagger is present on the work site, no workers may enter the area <br />between the track and the safety fence for any reason. No equipment may be operating within the <br />25-foot (ouling zone, or any other work occurting within a distance allowing materials or equipment <br />to swing over or occupy the area belween the track and the fence. <br />F. BNSF requires that lhe Contractor incorporate specific "Safety AcGon Plans' into its safety <br />program, provide a copy of lhe 'Safety Acfion Plan" to the BNSF Roadmaster prior to <br />commencement of any vrork on Railway Property, and shall periodically audi; ihe plans. <br />Contracior shall aChere to and comply with BNSf n�les related to contractor safety and operating <br />requirements. <br />Operations of hains and rail faciliNes: <br />�. BNSF operating personnel will be �esponsible for operating the existing facili6es ihroughout the <br />performance of the work. Existing track and signals must be available to BNSF personnel at all <br />Gmes for use, maintenance and repair. If BNSF instructs the Contractor lo move the ConUactors <br />equipment, materials or any installed material, which is loc3ted within the BNSF right-0f-way, the <br />Page 49 of 50 <br />
