PORT OF EVERETT <br />W MARINE VIEW DR <br />IMPROVEMENTS <br />CIP NO. 3-0-003-09 <br />PROJECTNO. <br />PD•WM•20006-01 <br />Contractor shall do so prompUy. The Contractor shall not adjust or operate BNSF serviceable or <br />funcfioning Uack or signal systems without prior written authorization from BNSF as appropriate. <br />H. The ConVactor must coo�dinate its Work so that there will be no delay to trains, or interfe2nce in <br />any manner with the operation of Vains without prior written authoriza6on from BNSF as <br />appropriate. <br />I. The Contractor shall rwt fake any BNSF tacility or equipment out of service without prior written <br />approval from BNSF as appropriate. Any reques� by the Contractor to take BNSF facilities or <br />equipment out of service shall be made to BNSF no less ihan one week prior to the bme it is <br />necessary to take the facility or equipment out of service. <br />J. The Contractor shall protect the BNSF Vack and signals from expasure to concrete, debris, dirt <br />and water during the Work. <br />K. The Contractor sfiall comply with the instrucfions of the BNSF flaggers, and oiher BNSF work <br />tor�es. <br />L. If damage is sustained by any of the existing signal and communications equipment, underground <br />or above ground, as a resuR of the Contractors operoGons, whether the damage sustained was <br />intentional or not, the Contractor shall immediately infortn BNSF as appropriate. The Conhactor <br />will be responsiCle for paying tor the wsts o` repair or repiacement, inciudirg, but not limited to, <br />the tollowing charges: <br />1. Replacement of the damaged equipment. <br />2. Any necessary inspec6on and tes6ng of the system, before and after repair or <br />r�placement of the damaged equipment. <br />Page 50 of 50 <br />
