is <br />result from the r,oncumnt negligence of (1) the Contractor, iu employees, subcontractors <br />or agenu and (2) che City, iu officers, agenu and employees, the indemnity provisions <br />provided herein shall be valid and enforceable only to the extent provided by law; and (B) <br />solely for the purpose of this indemnificadon and defense, the Contractor specifically <br />waives any immunity under the State Industrial Insurance Law, Tide 51 RCW. The <br />Contractor recognizes that this waiver of immunity under Tide 51 RCW was specifically <br />entered into pursuant to the provisions of RCW 4.?4.115 and was the subject of mutual <br />10. <br />11 <br />�mwsn <br />negotiation. <br />Submission of Renorts and Other pocuments. The Contractor shall submit monthly <br />reports to the City such as data reports, progress reports, records and other documents <br />relating to the Agreement as specified in the attached E.�chibit D-"Reporting Standa,3s". <br />Conuactor is specifically required to submit all information required in this Agreement <br />not later than 7uly 15, 1997. Said information shall be subject to review by the City, and <br />if found to be unacceptable under the terms of this Agreement, it shall be revised by che <br />Contractor to the extent necessary to render it acceptable and resubmit it with all pmctical <br />dispatch. <br />Insurance. Conuactor shall take out and maintain insurance in the following minimum <br />ariounts during che entire performance of its duties pursuant to this Agreement. <br />a. Vehicle Insurance. Contractor agrees to include the City as an additional <br />insured on all automobile liabiliry insurance policies which cover vehicles used by the <br />Contractor in the perfi�rmance of its duties under the Agreement and proof thereof shall <br />be provided to the City prior to the performing services pursuant to the Agreement. A <br />statement certifying that no vehicle will be used in accomplishing this Agreement may be <br />substituted for the above insurance requicement. <br />b. Comprehensive General Liability Insurance, includin� blanicet contracrual <br />liability and broad form property damage liability.
