The specific regulations apply to all of the proposed development of the project. There are Rlso General Regulations of Use Activities which apply to the proposal. All of these regulations are set forth in the City of Everett's Shoreline Masser Program 5. The Everett Master program has regulations regarding air and water quality for shoreline projects. (These regulations are set forth in the Shoreline Master Program, General Regulation i11.) The City determinec that the proposed prcj ct will satisfy the existing regulations for air and water quality. This will be accomplished by requiring that all avatar quality standards of the Department of Fisheries and Wildlife and stormwater guidelines are sat'sfied as well as all water quality regulations of the Army Corps of Engineers. In addition, the Washington State Department of Fish and Wildlife will review the proposa! prior to any activity being done on -site. The review will include review of any activity below the ordinary high water mark 6. Activity bol)w the ordinary high water mark will not be allowed during the fish window as determined by the Washington Department of Fish and Wildlife and especially when juvenile salmonoids are migrating down river. The specific requirement:. for restrict!ons of work during the ordinary high water mark are set forth in exhibit #6 of It)-) s,)oriw'e comments. Use of piling, umber, and other materials trealod with craoso-a and char wood preservatives Is discouragec by the Department of Fish and Wildlife. This restriction on ttheso toes will insure better water quality. 8. Shading of the water, which has an impact on fishery, is a concern of the Department of Fish and Wildlife. The Department of Fish and Wildlife has recommended that in order to educe shading, overwater and flcating structures must avoid marine vegetation and be constructed in a manner that solid decked areas are limited to 8 feet or less in width. In addition, deck surfeces greater than 8 feet in width that are located in intertidal, shallow, and shallow subtidal zones must incorporate grating materials that will allow light to shine on the habitat below. In addition, this grated area shall not be used for storage.
