ATTACHMENT "A" <br />Based upon the precE:ding findings of facts and conclusions, testimony and evidence <br />submitted at the public hearing, and upon the impressions of the Hearing Examiner of a <br />site view, it is hereby ordered that the shoreline permit #9-92 is granted subject to the <br />following conditions: <br />1� of Ever ett ShoreNnecMaster Programeand all othereocalnSt euand Feder le Ci�y <br />regulations. <br />2. The proposed project will be required to meet sxisting regulations regarding air <br />and water quality. To msure that this facility meets all air quality standards, the <br />Puget Sound Air Pollution Control Agency will be responsible for the review and <br />issuance of a Notice of Construction prior to issuance by the City of Everett of <br />any construction permits. <br />3. The Depa�tment of Fisheries must grant a Hydraulic Project Approval prior to <br />any actiwty below the ordinary high water mark. The Applicant must satisfy the <br />water quality section of the Department of Fisheries Stormwater Guidelines. <br />4. The Department of Fisheries will not permit barge grounding and_the Applicani <br />must schedule off-loading activities with the tide cycle to prevent grounding. <br />5. The Army Corps of Engineers must issue a Section 10 Permit prior to any in- <br />from March 15 to July/1 dur nlg he 'fish w ndowl' when juvenrile s�lalmon ds a�oe ed <br />migrating down river. <br />6. The Applicant should use concrete andlor steel pilings where structural support <br />is needed m water and over water. Untreated or less-toxic wood pilings will be <br />��sed for fender piles. <br />7. Stormwater quality enhancement is required on site by both the City of Everett <br />ana the Department of Fisheries. A wetpond is required for stormwater <br />trF�atment per City standaras. Public Works Department <br />9. All chemicals or products of a hazardous or toxic nature must be stored under <br />cover and isolated from the storm drainage system. Containment for the liquid <br />asphait and diesel fuel tanks on the site must be provided in a manner <br />acceptable to the Public Works Department. The tanks must be surcounded by <br />containment walls, covered by a roof, and no drainage outlet may be provided <br />for the containment areas. In addition, the containment volume must be equal <br />to, or greater than, 110°� of the volume of the largest container to be stored in <br />the area or 10% of the potential storage, whichever is the largest volume.
