bedrooms were occupied by individual tenants on the main floor, another tenant <br /> occupied the upper floor with her 13-year-old son, and two persons had recently <br /> moved into the basement. The basement appears to have been recently converted <br /> to finished space without required building permits, the ceiling height was <br /> approximately 72 inches, and the sleeping room had no windows. The Snohomish <br /> County Auditor property summary describes the structure as a single family <br /> residence with two bedrooms and one bathroom, yet there are now a total of four <br /> bedrooms on the main and upper floors, <br /> A. The current use of the residential structure is consistent with that of a rooming <br /> house. Rooming houses are prohibited in R-2 zones, as indicated in Table 5.1 <br /> within EMC 19.5. The Everett Municipal Code (EMC) permits a maximum of <br /> two roomers within a single family house in single family zones, or up to four <br /> unrelated adults if they operate as a family as defined by EMC 19.4.020. The <br /> existing conditions violate EMC 19.5.010 and EMC 19.39.060 which read; <br /> EMC 19.5.010 Permitted uses, prohibited uses, <br /> Land uses which are listed in the use table of this chapter shall be permitted <br /> subject to the review process listed in the table for a specific use in a particular <br /> use zone. If a use is not listed specifically or generally in a specific zone in the <br /> use table, it shall be considered to be a prohibited use in that zone. See Section <br /> 2.080(D)(2) for information on planning director interpretations on uses which <br /> are not listed in the use tables. <br /> EMC 19,39.060 Boarding and rooming. <br /> In single-family zones, rental of rooms for lodging is limited to two roomers. <br /> There shall be no separate kitchen facilities in rented rooms. <br /> B. The lack of permits for the alterations to the structure is a violation of <br /> International Residential Code (IRC) R105.1 which reads: <br /> IRC R105,1 Required. <br /> Any owner or authorized agent who intends to construct, enlarge, alter, <br /> repair, move, demolish or change the occupancy of a building or structure, <br /> or to erect, install, enlarge, alter, repair; remove, convert or replace any <br /> electrical, gas, mechanical or plumbing system, the installation of which is <br /> regulated by this code, or to cause any such work to be done, shall first <br /> make application to the building official and obtain the required permit. <br /> C, The use of the basement for sleeping purposes is prohibited by the <br /> International Property Maintenance Code (IPMC) 404.4.4 and <br /> 404.4.5, and renders the structure Unlawful as defined by IPMC 108.1.4, in <br /> violation of IPMC 106.1, which reads: <br /> Everett Police Department, Code Enforcement Unit• 3002.Wetmore Ave• Everett, WA 98201 •425-257-8560 <br /> Page2of5 <br />
