' � <br /> . , <br /> NOTICE OF CITY ACTION <br /> PLANNING DIRECTOR DETERMINATION <br /> II.0 #I-92 <br /> Dear Citizen: <br /> The City of Everett Zoning Code requires you ro be notified as an owner of property <br /> within 300 feet of the 7300 Block of Rainier Dri�e of the following action: <br /> The City oP Everett Planning Director grants approval of a request by Homestead <br /> Alternatives to culvert approaimately 14 li„eal feet oP Pigeon Creek No. 1 at <br /> annrnximately 73rd and Rainier Drive c`th the follnwing cnnditinns: <br /> ,� 1. Enhance the Pigeon Creek No. 1 and its buffer as proposed under the Stream <br /> Enhancement and Rehabilitation plan prepared by Wetland Resources dated <br /> April 10, 1992, except the west bank of the stream must be planted with ten <br /> spreading evergreen trees a minimum of five feet in height and twenty shrubs a <br /> minimum of two feet in height. If it is found that the owner of the shopping center <br /> to the west of the stream removed vegetation within the City right-of-way, the <br /> owner will be required to contribute towards replanting this area. My <br /> modifications must be approved by the Planning Department. <br /> 2. The stream and buffer enhancement must be compl�ted prior to the issuance of <br /> Building pertnits or a bond worth 300°/a of remaining improvements must be <br /> submitted to the Planning Department. <br /> 3. Provide a permanent fence a minimum of 42" high along the boundary of the buffer <br /> on both sides of the stream. Solid board, post and rail, chain link, picket fence or <br /> other type of fence that is acceptable to the Planning Department must be used. <br /> The fence must be posted with a minimum of two Env:ronmentally Sensitive Area <br /> signs. The signs are available from the Planning Department for a fee. <br /> 4. Provide the City of Everett Planning Department a two year assurance device <br /> worth 10% of the cost of planting the streambed and its buffer prior to issuan�e of <br /> Public Works pertnits. <br /> Subsection 37.150.B allows alteration of a Category IV streams if it is necessary for <br /> access to the development and that the loss of the functional values of the altered stream <br /> can be replaced. <br />
