Water supply intakes. Plo rllscharqe of dredged or fill material may <br /> occur in tlie proximity of e public water supply intake except wliere the <br /> riisrliar4e is for repair of the public water supply inteke structures or <br /> ad,jacent bank stabilization. <br /> 2. Shellfish �roduction. No discharge of dredged or fill material may <br /> ocrur in areas of concentrated shellfish production, unless the discharae is <br /> direcl:.ly related to a shellfish hervesting activity authorized by NWP 4. <br /> 3. Suiteble material. No discharqe of dredged or fill material may <br /> r,ons.ist of unsuiteble material (e.g. , trash, debris, car bodies, etc.) and <br /> material discharged must be free from toxic pollutants in toxSc amounts (see <br /> Sect.ion 307 of the Clea� 'dater Act) . <br /> h. Mitigation. Discharges of d� �' ! -: fill meteriel into waters of the <br /> Unl.ted States must be minimized or a�.c ��.:.; '. the maximum extent practir.able <br /> at the project site (i.e. , onsite), w��es� c�ie District Engineer has approved <br /> a comrensation mitigation plen for the specific rewleted activity. <br /> 5. Spawning areas. Discharges in s�awninQ ereas durinq spawning seasons <br /> must be evoided to the maximum e::tent precticable. <br /> 6. Obstruction of high flows. To the maximum extent �racticahle, <br /> discher�es must not permenently restrict or impede the passage nf normal nr <br /> ex��ected hiqh flows or cause the relocation of the water (unless the primary <br /> purpose of the fill is to impound weters). <br /> 7. Rclverse impacts from impoundments. If the discliarge rreates an <br /> impoundment of water, adverse impects on the equntic system caused by the <br /> qrrnlCreted (�aSs��e of water end/or the restriction of its flow shell hr.. <br /> mi�imized to the maximum extent practicable. <br /> S.
