BOARD OF ADJOSTlfENT
FINDINGS, CONCLUSIONS ANU ORDFR
VARIANCE N0. 2-89
Based upon the written request for a variance from the City's Zoning Code by:
D. Ross Perry
4031 Lincoln Way
Lynnxood, WA
hereinafter referred [o as "Applicant," Eor a variance from E.M.C. :
19.18.040(A), Front Yards and (B), Rear Yards for construction of
three multiple family dWellinga on three aeparate lote. For Lot 4, a
ten foot rear yard is proposed instead of the tventy foot required by
Code. For Lot 3, a ten foot rear yard is propoaed inetead of che
twenty feet required by Code, and for Lot 2, a ten foot front yard
and a ten foot rear yard instead of the twenty feet required by Code.
on the following described property:
Lots 2, 3 and 4 of Short Plat of Lot 4, Plat of Valley View, as
recorded in Vol. 1687, p. 1644, Records of Snohomish County.
c:,,nmonly known as: 7601 Ridgewood
The Board of Aduatment, folloxing a public hearing on said application held
on February 6, 1989, and further having reviewed all teatimony, makes the
folloaing Findinge, Conclusions and Order:
FINDWGS AND CONCLUSIONS:
Criterion U1: That there have been exceptional or eztraordinary
circumstances or conditions applying t the subject property
or as to the intended use thereof that do not apply
generally to other properties in the same vicini[y or zone.
a. Find3ng; The subect property consists of three
separate vacant lots, each slightly more than 6,200
square feet in area. The zoning is R-3, Mul[iple Family
Low Deneity Residential, which requirea 1500 square feet
of lo[ area per dwelling unit. Each lot has the
potential Eor four dwelling units iE all Zoning Code
requirements are met. The property is being marketed
and tiie potential purchaser wiahes to construct a
fourplex on each lot. The applicant feels thzt in order
to be able to get four units on each lot, he must have a
variance for rear setback.
Since the site is vacant, there is a great deal of
design flexibility available, and it should be poseible
to design a project to meet all Zoning Code requirements
vithout obtaining a variance. The site plan submitted
by the applican[ is purely speculrive and does not make
any provision for a usable front yard, and the ten foot
rear yard area is not adequat to provide any usable
open space as is customary in this vicinity and zone.
b. Conclusion: iince [he site is vacant, it should be
possible to design a project to meet 2oning Code
requireme:ta, and the conclusion is there are no unusual
or extraordi.nary circumstances applying to this property
that do not apply generally to the vicini[y and zone.
