3 <br /> vacancies shall be filled; for a period of probation before employment is made <br /> permanent; and for promotion on the basis of merit, experience and record. <br /> (b) Employees within the scope of this article who are in office at the time of the <br /> adoption of this charter shall retain their positions, unless removed for cause. <br /> (c)The council may, by ordinance, confer upon the commission such further rights and <br /> duties as may be deemed necessary to enforce and carry out the principles of this article. <br /> (d) The commission shall have such rights, powers and duties as to enable the city, <br /> through such commission, to substantially accomplish the purpose of Chapters 41.08 and <br /> 41.12 of the Revised Code of Washington. <br /> PROPOSITION #10 <br /> Shall Everett City Charter Section 8.3, referring to the Civil Service Commission be <br /> changed to conform to existing Washington State law? <br /> CHARTER CHANGE YES ❑ <br /> CHARTER CHANGE NO ❑ <br /> Section 13: Change to Section 8.4 Section 8.4 of the Everett City Charter, <br /> which reads as follows: <br /> Removals. <br /> An employee may be suspended by the head of the department under which he is <br /> employed and thereupon his compensation shall cease. The officer making the order <br /> shall forthwith file with the Civil Service Commission a statement of the suspension and <br /> the reasons therefor. Within ten (10) days after his suspension, the employee so <br /> suspended may file an appeal with the Civil Service Commission. The commission shall <br /> thereupon cause notice of the time and place when and where a hearing on said appeal <br /> will be had, which hearing shall be within (10) days after such appeal shall have been <br /> taken. The commission shall cause written notice of the time and place when and where <br /> such hearing shall be had to be served on such employee at least two (2) days before the <br /> hearing. All such hearings shall be public, and the employee shall have the right of legal <br /> counsel at such hearing.
