The apecial conditiona applying to thie property are the <br />following: The property is a emall city lot of 25' x 120' with <br />a substantiel brick, eingle i�mily .structure. The character of <br />the neigliborhood is changing and th�:re ie an apartmant complex <br />to the north and a law office on the sou[h so i[ ie no longer <br />desirable as a aingle family reaidence. The property iR <br />advantageously situated close to the court house for [he <br />proposed businesa and Uns been in the family of one of the ' <br />proposed b�ainess owner's aince 1922 and they would like to <br />keep it in tl�e family. <br />Property in the immediate area has been developed along <br />substantially the same linea. Tliat is, the better condition <br />buildinge have been converted to office epace and aome of the , <br />lese deairable onea have been demolished and new office epace <br />�onetructed. Ownerahips have been coneolidated in the <br />immediate area vhich leads one to the conclueion [hat nev <br />offices are forthcoming. The area will probably cantinue to , <br />develop as office and multi-family residentiul epace. Inasmuch <br />as the current property owcier only hae 25 feet of width, it <br />aeeme unlikely that [hey will be able to develop any new <br />building and thus converaion of the present residence to office ', <br />would be their maln alternative. <br />b. Conclueion: There are excepti-nal and extraordinary . <br />circumstances applying to the subject property and to the <br />intended use [hereof. <br />Criterion 2: That euch variance ia necessary for the preservation and � <br />enjoyment of a aubatantial property right of the , <br />app^llant pcesesaed 'oy the ownera of other propertiea in <br />the eame vir:inity or zone. <br />a. Ftnding: The Applicant will be providing aix apaces ae ' <br />required by Code even though technically only three of them may , <br />be counted. I <br />b. Conclueion: The variance requeat seema reasonable. <br />Criterioa 3: That the authorization of auch variance will not be ', <br />materi.ally detrimental to the public welfare or injurious <br />to pr.operty in the vicinity or zone in rrhich the property <br />ie J.ocated. <br />a. Finding: The Applicant will actually be providing eix parking <br />spaces as required by Code even though three of them will not <br />meet Public Works apecificatione for accesa, and the nature of <br />the pcoposed use is such tliat tliis should adequately serve the <br />bueinesa. Other City departments had no adverse commenta on <br />thie request and no comment has been received in response to a <br />nottice sent to ownera W.lthin 300 feet of the subject property. <br />b. CoricLusion: It doea not appear that this variance aould be <br />materially detrimental to the p�blic welfare or injurious to <br />property in the vicinity or zone. <br />d� <br />
