each unit. The positive design characteristics could not be provided without the <br />proposed modifications. The duplex would have to be attached to the existing duplex or <br />a side -by -side duplex with porches could not be built. <br />3. The arrangement of buildings and open spaces as they relate to other buildings <br />and/or uses on the subject property and on surrounding properties. <br />Findings: A minimum of 600 square feel of open space is required by EMC 19.040.B. <br />Over 1,100 square feet of open space will be provided. The open space is located to the <br />east of the proposed and existing duplexes. The proposed duplex will have <br />approximately the same front and rear setbacks as the existing duplex. <br />Conclusions: Adequate open space will be provided. <br />4. Visual impact to surrounding properties caused by parking facilities in the <br />proposed development and whether such impacts are less than would result from <br />compliance with the development standards and/or design guidelines proposed to be <br />modified. <br />Findings: Eight off-street parking spaces will ne provided. The spaces will be accessed <br />from the alley as required by EMC 19.15.070. EMC 19.15.070.1) requires a five-foot <br />high solid fence to separate the parking from adjacent properties. <br />Conclusions: The fence required by EMC 19.15.070.D will reduce visual impacts. <br />5. Does the proposed design mitigate the impacts that could be caused by relaxation of <br />the standards which are proposed to be modified. <br />Findings: The front fagade of the proposed duplex provides modulation, prominent <br />covered porches, and use of different siding materials. <br />Conclusions: The reduced setback between the proposed and existing duplexes does not <br />impact adjacent properties. <br />DECISION: The Planning Director APPROVES a seven -foot building setback between the <br />existing and proposed duplex with the following conditions: <br />1. Any change to the design of the duplex requires Planning Director Approval. <br />Planning and Community Development Department <br />INFORMATION FOR THE DEVELOPER <br />If a complete application has not been filed for a building permit or equivalent <br />construction permit within eighteen (18) months from the approval date of this <br />decision, the permit shall be deemed terminated, unless an extension is granted. If <br />the permittee requests an extension in writing not later than eighteen (18) months <br />from the land use permit date, the Director may grant a six (6) month extension. <br />?3 <br />
