'V li TT. <br />Engineering/Pu*;k�efvwcas <br />SUBJECT: Meeting confirmation, Hydraulic Project Approval, 10430 Rosewood <br />Avenue, Unnamed Tributary to Swamp Creek, Section 23, Township 28 North, <br />Range 4 East, Snohomish County, WRIA 08.0059, WDFW Control No. F-1439-02 <br />This letter is to confirm our meeting today at the above -referenced address. Present at the <br />meeting were you and I, along with Phil Jensen, Washington Department of Fish and <br />Wildlife (WDFW) Engineer and Cliff Lindman, City of Everett. <br />The meeting was held to discuss your installation of an unpermitted culvert. I explained <br />that the culvert was installed without a current Hydraulic Project Approval (HPA) and <br />was a violation of the Hydraulic Code, RCW 77.55.011(7) and 77.55.021. HPA F-1439- <br />02 had expired on December 31, 2003. I also explained the culvert was not installed per <br />HPA provisions 16, 17 and 18 (copy attached). <br />The following was agreed to at the meeting: <br />1. The undersized culvert will be replaced with an appropriately sized culvert. <br />2. The new culvert will be designed using WDFW's "Design of Road Culverts for <br />Fish Passage" manual. The manual is available on the internet at the following <br />link: http://www.wdfw.wa.pov/hab/engineer/cm <br />3. You will submit the requested drainage study reports to Phil Jensen. Phil will <br />assist you in sizing the culvert. <br />4. You will submit a new Joint Aquatic Resources Permit Application Form <br />(JARPA) along with detailed plans of the new culvert. <br />5. After acceptance of the application package, WDFW will issue a new HPA to <br />remove the existing culvert and install the new culvert. <br />6. No work shall take place below the Ordinary High Water Line (OHWL) without a <br />current HPA. <br />
