BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 12-87 <br />5 1P M � �dr <br />JUL 1 31987 <br />CITY OF EVERETT <br />Pubic Works Dept. <br />Based upon the written request for a variance from the City's zoning code by: <br />John Y. Sato and Assoc. <br />dba Dagmar's Landing /B7/-,eat ,Srve <br />1200 112th Ave. N.E., C-185 <br />Bellevue, WA 98004 <br />hereinafter refered to as "Applicant," for a variance from E.M.C. <br />19.11.050(C)(1), (2). and (3) to allow construction of: <br />A. Alterations and repair to an existing 4,200 sq. ft. boat repair <br />shop and <br />B. Construction of a 6,075 sq. ft. temporary boat sales building, <br />that would not meet the following zoning code requirements: <br />(1) the first floor of all structures be two feet above the <br />regulatory flood protection elevation; <br />(2) that for fifteen feet beyond the structures the elevation <br />be two feet above the regulatory flood protection elevation; and <br />(3) that beyond fifteen feet the elevation be not lower than <br />one foot below the regulatory flood protection elevation. <br />on the property cor.,monly known as Dagmar's Landing at 1871 Ross Ave. on <br />Smith Island. <br />The Board of Adjurtment, following a public hearing on said application held <br />tin July 6, 1987, and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have been exceptional or extraordinary circumstances or <br />conditions applying to the subject property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Finding: The variance request is for two separate structures that <br />would be accessory uses at an existing marina. <br />A. Existing Boat Wash Shed <br />A portion of this building was constructed several years ago <br />prior to John Y. Sato & Associates ownership involvement in the <br />property. A cost estimate of the existing construction is in <br />file. The original structure (prior to alterations) is <br />estimated to have cost $52,814.00 with the proposed alterations <br />and repairs to cost $19,960.00. <br />Some of the repairs to the building are to protect the <br />structure itself from further deterioration while the <br />alterations proposed will allow use of the building for boat <br />repairs which will enhance the services provided to the boat <br />moorage customer. <br />The existing floor slab is at 7.9" elevation which is 1.1 feet <br />lower that the 9.0 foot regulatory flood protection elevation <br />at this point. The dike varies in height from 11 feet to 12 <br />feet. In order to flood proof the structure the applicant <br />
