CONCLUSIONS <br />SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT <br />5. The proposal is located at 1871 Ross Avenue, Everett, Washington. Because of <br />its c�ose proximity lo the Snohomish River, a shoreline of signif+cance in the State <br />of Washington, and because the proposed project exceeds the $5,000 ihreshold <br />construction amount, a Shoreline Permit is required. It is required for the <br />construction of the 12-foot by 26-foot equipmenl building and the cellular antenna <br />within a 150-fool tall fiagpole. (finding 32) <br />The proposed use is a permitted use in the Urban, Mixed-Use Industrial <br />designated area. It is a non-water oriented utility. The Applicant has <br />demonslrated that no reasonable options exist for another localion. (finding 34) <br />The utility insfaliation in the slioreline area would be designed and installed to be <br />aesthetically pleasing (a ilagpole to (ly a flag of the U.S., Washington, or Everett; <br />or noncommercial institulions). It would not significantly impact the view of the <br />shoreline. (finding 35) <br />8. The proposed project has been reviewed pursuant to the Shoreline Master <br />Program Element Regulations. The regulations for the Shoreline Use Element, <br />Cultural Resources Element, Flood Hazard Reduction Element, Public Access <br />Element, and Conservation Element have all been considered. The proposal <br />satisfies these elements. (finding 36) <br />Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a liearing and to issue tl�e decision. That authority is set forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the Nearing Examiner enters the following <br />Conclusions: <br />DECISION <br />Based upon the preceding Findings of Fact and Conclus�ons and iestimony and <br />evidence submitted al lhe public hearing, ii is hereby r,rdered that the request for a <br />Special Property Use Permit and Shoreline Management Substantial Development <br />Permit to allow installation of a 150-foot tall flagpole with a wireless antenna and a 12- <br />foot by 26-foot equipment building are granted subject to the following conditions: <br />Conditions for Special Propertv Use Permit <br />The proposed antenna shall be concealed as generally depicted in exhibits 4 and <br />5. Ali co-located antennas shall be similarly concealed. Cabling and conduits <br />shall be located inside the pole, rather than outside the pole. <br />� <br />/ <br />
