CONCLUSIONS
SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT
5. The proposal is located at 1871 Ross Avenue, Everett, Washington. Because of
its cose proximity lo the Snohomish River, a shoreline of signif+cance in the State
of Washington, and because the proposed project exceeds the $5,000 ihreshold
construction amount, a Shoreline Permit is required. It is required for the
construction of the 12-foot by 26-foot equipmenl building and the cellular antenna
within a 150-fool tall fiagpole. (finding 32)
The proposed use is a permitted use in the Urban, Mixed-Use Industrial
designated area. It is a non-water oriented utility. The Applicant has
demonslrated that no reasonable options exist for another localion. (finding 34)
The utility insfaliation in the slioreline area would be designed and installed to be
aesthetically pleasing (a ilagpole to (ly a flag of the U.S., Washington, or Everett;
or noncommercial institulions). It would not significantly impact the view of the
shoreline. (finding 35)
8. The proposed project has been reviewed pursuant to the Shoreline Master
Program Element Regulations. The regulations for the Shoreline Use Element,
Cultural Resources Element, Flood Hazard Reduction Element, Public Access
Element, and Conservation Element have all been considered. The proposal
satisfies these elements. (finding 36)
Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to
hold a liearing and to issue tle decision. That authority is set forth in EMC 15.16.100.
Based on the above Findings of Fact, the Nearing Examiner enters the following
Conclusions:
DECISION
Based upon the preceding Findings of Fact and Conclusons and iestimony and
evidence submitted al lhe public hearing, ii is hereby r,rdered that the request for a
Special Property Use Permit and Shoreline Management Substantial Development
Permit to allow installation of a 150-foot tall flagpole with a wireless antenna and a 12-
foot by 26-foot equipment building are granted subject to the following conditions:
Conditions for Special Propertv Use Permit
The proposed antenna shall be concealed as generally depicted in exhibits 4 and
5. Ali co-located antennas shall be similarly concealed. Cabling and conduits
shall be located inside the pole, rather than outside the pole.

/
