•• <br /> C7-yi <br /> • <br /> • 3-CONTRACT FOR MANAGEMENT OF I <br /> PRIVATE WASTE DISPOSAL SYSTEM <br /> 12.0 OWNER represents that the person signing this agreement is fully authorized to sign this <br /> agreement on behalf of OWNER and that such Individual shall be charged with the responsibility In regard to <br /> maintenance and operation of OWNER'S private sewage system and the maintenance and operation of the <br /> holding tank in connection therewith. Any change of responsible party by OWNER shall be communicated <br /> in writing to the HEALTH DISTRICT with appropriate designation of name, address, and other means of <br /> communication. <br /> 13.0 It is understood that the HEALTH DISTRICT will incur costs in the supervision of this contract <br /> and the inspection of the private onsite sewage system of the OWNER. It is contemplated that routine <br /> inspections will be made by the HEALTH DISTRICT of the system, the records maintained by the OWNER, <br /> the pumping of the holding tank and the delivery of the sewage to appropriate treatment facilities. OWNER <br /> will pay to the HEALTH DISTRICT the Holding Tank Permit Fee upon the execution of this contract. An <br /> annual charge of $180.00 will be payable by the OWNER to SNOHOMISH HEALTH DISTRICT at the <br /> beginning of the calendar year following the issuance of a Certificate of Occupancy of the premises. On the <br /> anniversary date of this contract, the parties will review the inspection fee payable by the OWNER to the <br /> HEALTH DISTRICT and such fee may be adjusted in the discretion of the HEALTH DISTRICT not to exceed <br /> ten percent (10%) of the annual amount initially paid by the OWNER to the HEALTH DISTRICT. <br /> Subsequent annual adjustments in the inspection fee will be made on the same basis with a maximum of <br /> ten percent (10%) increase over the Initial fee per each twelve (12) month period In the discretion of the <br /> HEALTH DISTRICT. <br /> 14.0 In the event of any overflow of sewage onto the ground and/or into ground water, or any <br /> other unsanitary condition creating the potential for public health hazard occurring onsite as it relates to the <br /> private waste disposal system utilizing a holding tank, OWNER shall be required to pay for the additional, <br /> reasonable, and necessary inspections by the SNOHOMISH HEALTH DISTRICT at the rate of $45.00 per <br /> inspection, and shall be obligated to pay this additional inspection fee up through a total of 4 Inspections <br /> after the condition has been rectified by OWNER. Such fees shall be due within 4 days of notice of <br /> such fee. <br /> 15.0 It is expressly understood that the private waste disposal system utilizing a holding tank is of <br /> the OWNER'S design and specification, and the approval of such proposed system by SNOHOMISH <br /> HEALTH DISTRICT does not constitute a representation, warranty, or guaranty of said design or its <br /> functioning. Rather, approval by SNOHOMISH HEALTH DISTRICT constitutes a prerequisite to receiving a <br /> permit, and such approval, based upon OWNER's submittals, only constitutes authorization for applicant to <br /> proceed with a system as so designed and specified and is a matter of public record in the office of the <br /> HEALTH DISTRICT. <br /> 16.0 OWNER agrees to indemnify and save harmless the HEALTH DISTRICT from claims of any <br /> third parties, including abutting landowners, who may claim damage by reason of OWNER's utilization of an <br /> onsite sewage waste disposal system utilizing a holding tank as contemplated by OWNER's submittal to the <br /> HEALTH DISTRICT and hereinabove described. <br /> 17.0 Public health, safety and welfare is of the essence of this agreement, and any of the. <br /> following events, hereinafter described shall be deemed "events of default," to wit: <br /> 17.1 Any failure to perform by the OWNER, its successors, purchasers, tenants or persons or <br /> entities occupying the OWNER's site under any arrangement with the OWNER, as required by any <br /> covenant or agreement herein; or <br /> 17.2 Any failure to connect to a public sewer when such sewer system is available;or <br />
