2- CONTRACT FOR MANAGEMENT OF <br /> PRIVATE WASTE DISPOSAL SYSTEM <br /> 2.0 OWNER shall not allow sewage to overflow or otherwise be disbursed onto the surface <br /> ground and/or into the ground water and/or into the subsoil. <br /> 3.0 The holding tank shall be used only for the limited purposes as identified in the application <br /> and information submitted at the time of application. <br /> 4.0 OWNER shall provide to the SNOHOMISH HEALTH DISTRICT a copy of the contract with <br /> the qualified company or entity providing the services identified in Paragraph 1.0 above; notice of <br /> cancellation as well as a subsequent contract entered into with a pumping and hauling company. <br /> 5.0 " OWNER shall provide and maintain records relative to pumping of said system, and make <br /> said records available to the SNOHOMISH HEALTH DISTRICT. <br /> 6.0 OWNER agrees to allow SNOHOMISH HEALTH DISTRICT, without requirement of any <br /> advance notice, access to the property for the purposes of examination of the private waste disposal <br /> system. <br /> 7.0 OWNER agrees to comply with any Health Officer's order issued by the SNOHOMISH <br /> • HEALTH DISTRICT relative to said private waste disposal system utilizing a holding tank. <br /> 8.0 When public sewers become available to serve OWNER's site, OWNER agrees to take steps <br /> at OWNER's expense to connect the disposal of sewage waste generated upon OWNER's site to such <br /> public sewer system, including entering into a sewer district authority's Standard Developer Extension <br /> Agreement and such other undertakings as may be necessary in order to obtain sanitary sewer service to <br /> OWNER's site. Upon notification of sewer availability from the appropriate sewer district, OWNER will <br /> commence construction of the hook-up immediatly, with completion within 60 days. <br /> 9.0 It is expressly understood by OWNER that at all times OWNER remains responsible for the <br /> maintenance and operation of the onsite sewage system serving OWNER's site, and remains expressly <br /> responsible for the surveillance of the functioning of the sewage system, and the record keeping <br /> associated therewith. <br /> • 10.0 OWNER agrees that If the property subject to this agreement is to be sold or leased, or in <br /> any manner disposed of by OWNER, that as a condition of such disposition or transfer, the transferee, <br /> lessee, tenant, or otherwise shall be required to adhere to all of the terms and conditions of this agreement _ <br /> and will enter into a new agreement with SNOHOMISH HEALTH DISTRICT as a condition precedent to the <br /> acquisition of their interest. OWNER agrees to advise SNOHOMISH HEALTH DISTRICT of any such <br /> purchase or change in tenant and to inform any prospective purchaser, tenant or lessee that this existing <br /> agreement is non-transferable and that a new agreement will be required to be negotiated between the <br /> HEALTH DISTRICT and any new owner, tenant or lessee. Further, OWNER agrees that this agreement <br /> shall immediately be recorded by OWNER, at OWNER's expense,with the Snohomish County Auditor and <br /> shall provide the SNOHOMISH HEALTH DISTRICT with evidence of the same. <br /> 11.0 All amendments, supplements or addendums to this contract shall be in writing signed by <br /> the parties to this agreement or their successors in interest, and that any such amendments, supplements <br /> or addendums or deletions to this agreement must first be agreed to in writing and submitted to the <br /> HEALTH DISTRICT Board of Health for approval prior to such amendments becoming effective. <br /> 901210012) 4 <br /> PAGE1974 <br />
