/ 1,2 'WITNESSETH; WHEREAS, Dunlap lowing. Inc.. hereinafter referred to as the "OWNER" is the owner or entity having the right to possess and use the following described real property situated in the County of Snohomish, State of Washington, to wit: See attached Exhibit #1 which property is located in the County of Snohornish, State of Washington on which the OWNER operates or will operate a wood chip loading facility. WHEREAS, the OWNER has submitted an application to the SNOHOMISH HEALTH DISTRICT for a permit to install a sewage holding tank for the purpose of sewage disposal on the above- described site; and WHEREAS, WAC 248-96-110 (7) authorizes the use of sewage holding tanks under the limited circumstances and conditions defined therein; and WHEREAS, the SNOHOMISH HEALTH DISTRICT has reviewed the application and found it to be in compliance with applicable rules and regulations; and WHEREAS, the OWNER intends to contract with a qualified company or entity which will provide equipment, personnel and removal services for hauling sewage generated on the site, and contract with such company or entity to do so on a regular basis, so that no sewage shall overflow onto the surface of the ground, and/or ground waters; and WHEREAS, OWNER is prepared to agree to all other terms and conditions of this contract, and recognize its responsibility to establish a management system for the operation of a private waste disposal system to avoid the potential for public exposure to sewage and/or contamination of the environment; NOW, THEREFORE, The SNOHOMISH HEALTH DISTRICT hereby issues a permit to OWNER for the Installation of a private waste disposal system utilizing a holding tank in accordance with the plans, sketch, and information furnished by OWNER to the SNOHOMISH HEALTH DISTRICT, and subject to the following terms and conditions: 1.0 OWNER shall contract with a qualified company or entity to provide equipment, personnel, removal services for hauling sewage generated on the site, and shall so contract as to provide regular such service. Further, said company or entity retained shall maintain proper and adequate records of pumping and delivery of sewage to an approved disposal site. 1.1 The company or entity retained to provide the removal and hauling services shall be a pumping and hauling company who own a valid permit issued by the SNOHOMISH HEALTH DISTRICT. Further, said company or entity shall provide and utilize a motor vehicle equipped with a tank and pumping device sufficient to handle sewage flowing into the holding tank servicing the OWNER's property.
