.(6I9 [G-G2-? 7 <br /> FINDINGS AND DECISION <br /> OF THE HEARING EXAMINER OF THE <br /> CITY OF EVERETT <br /> IN THE MATTER OF THE APPLICATION <br /> OF HARNISH AUTO FAMILY FOR APPROVAL <br /> OF A VARIANCE VARIANCE #15-004 <br /> SUMMARY OF DECISION: A variance from the Special Regulation section <br /> of Table 5.2 of the City of Everett Municipal <br /> Code, Section 19.5 (Note 45[a]) is granted. <br /> The Applicant is allowed to provide vehicle <br /> servicing and repair shops as part of the <br /> dealership within 150 feet of residentially <br /> zoned properties, and, may have garage doors <br /> face residential zones. The variance is <br /> granted subject to conditions listed herein. <br /> INTRODUCTION <br /> Harnish Auto Family (Applicant) requested a variance from the Special Regulation <br /> section of Table 5.2 of the City of Everett Municipal Code (EMC), Section 19.5. <br /> Specifically, the variance requested is from the regulation, as set forth in Note 45(a) of <br /> the Special Regulations Table 5.2, which prohibits vehicle service and repair business <br /> within 150 feet of residentially zoned properties from having garage doors that face <br /> toward residential zones. The Applicant's construction proposal submitted to the City <br /> calls for the garage doors for an oil and lube service to be 130 feet from the nearest <br /> residentially zoned property. The property is located at 7307 Evergreen Way, Everett, <br /> Washington (subject property). <br /> A hearing on the request was held before the Hearing Examiner of the City of Everett on <br /> August 13, 2015.
