7 <br /> i.e., sixty-five (65)performances. At its option, Theatre may present four(4) different <br /> productions in a Year, but Theatre shall still present at least sixty-five (65) performances <br /> during that Year. City and Theatre shall jointly prepare and agree upon a schedule of dates <br /> for these performances. Except for the sixty-five (65)performance dates agreed upon as <br /> required above, all dates in any calendar year shall be under the control and direction of City. <br /> Theatre shall manage all aspects of its own productions, including, but not limited to, <br /> promotion, advertising, personnel selection, supervision, coordination with City, inventory, <br /> control and care of its own personal property, and inventory and care of City property. <br /> Theatre shall pay the City rent for Theatre's productions at the Center according to the rates <br /> in effect during the productions. <br /> B. KidStage <br /> Theatre shall provide theater classes and performance opportunities for Everett youth <br /> during the summer months of each year and shall provide a series of courses dealing with <br /> education and training in the performing arts (hereinafter referred to as"Kidstage"). No later <br /> than February 28th of each Year during the term of this Agreement, Theatre shall submit for <br /> City's approval a detailed written proposal setting forth all elements of its proposed program <br /> for that calendar year. City's approval will be in writing and will not be unreasonably <br /> withheld. No rent shall be charged Theatre for its use of the Center for KidStage classes and <br /> performances. <br /> C. Center Management <br /> Theatre shall manage the Center for City, including booking of performances and <br /> rental of the facility, and selection and management of the concessionaires. Theatre shall <br /> provide all of the staff support necessary to meet the needs of City in conducting City's <br /> activities at the Center, including City's third-party rental activity. Theatre will be <br /> responsible for implementing and carrying out all personnel support functions necessary to <br /> ensure successful accomplishment of its tasks and activities. City's Chief Administrative <br /> Assistant (or his or her representative) shall communicate to Theatre such tasks and activities. <br /> Each year Theatre's Executive Producer(or chief executive officer) shall confer with City's <br /> Chief Administrative Assistant(or his or her representative)regarding scheduling and <br /> coordination of City and Theatre events and review of Theatre's performance of this <br /> Agreement. In consultation with City, Theatre shall establish management practices for <br /> rental of the Center and the sale of concessions that implement any City policies and <br /> guidelines regarding rental or concessions. Theatre shall establish rental rates for the Center, <br /> subject to City's reasonable approval. <br /> D. Staffing <br /> Theatre shall staff the Center with at least the following full-time personnel: <br /> (1) "front of house"supervisor; <br /> (2) box office manager; <br /> (3) production/technical director; l <br /> EVERETT/VILLAGE THEATRE AGREEMENT Page 2 of 10 <br />
