7 <br /> (4) marketing/public relations director; <br /> (5) development director; and <br /> (6) office manager. <br /> Theatre will use reasonable efforts to minimize staff turnover. Staffing shall be maintained <br /> twelve (12) months of each year and the staff must be experienced and capable of performing <br /> the level of work assigned. Theatre will advise City of the background and qualifications of <br /> the staff. In its sole discretion and judgment, City may direct Theatre to remove or replace <br /> staff at any time whom City believes does not possess the requisite experience,training or <br /> level of knowledge to successfully carry out the tasks that will be required by the position. <br /> Theatre shall define each position by a written job description that fully describes the training <br /> and experience required, the scope of work and activities required, and the range of <br /> compensation to be offered. Theatre shall not discriminate in its hiring based on race, creed, <br /> religion, gender or national origin. Theatre is not required to cast people in roles that Theatre <br /> believes in good faith are artistically inappropriate for the production. <br /> E. Personal Property Maintenance <br /> Theatre shall be responsible for the care, maintenance, and replacement of its own <br /> personal property. Theatre shall also be responsible for the care and repair of City-owned <br /> personal property used by Theatre, excepting normal wear and tear. Theatre personal <br /> property shall include, but not be limited to, equipment,props,costumes and supplies, and <br /> other items listed on the inventory of Theatre property. <br /> III.PREMISES <br /> A. Theatre shall maintain the Center premises in good condition and shall not <br /> alter or change the premises without the prior written approval of City. <br /> B. City shall provide reasonable janitorial service and maintenance arising from <br /> the normal day-to-day use of the premises. However, Theatre shall make small routine <br /> repairs such as replacement of light bulbs, repair of faucets, switches, or similar small items. <br /> At its expense, Theatre shall maintain and repair the premises to the extent reasonably <br /> necessary due to the conduct of Theatre personnel, patrons, or agents acting on behalf of <br /> Theatre. <br /> C. City shall be responsible for paying the cost of the following services: <br /> water/sewer; electricity; gas; and garbage. Theatre shall be responsible for all other costs, <br /> including telecommunications. <br /> IV. TERMINATION <br /> A. For Default <br /> Either party may terminate this Agreement for material default upon thirty (30) days' <br /> written notice of the material default and intention to terminate.
