Notice. Use. The fotlo��ing provision shail be substituted for in its entirety and replace <br />the provision in Ariicle 3.05 of the Agreement: <br />Lessee shall use the Premises for the purpose of constructiag, rnaintaining and <br />operating a communications facility and uses incidental thereto and all necessary <br />appurte�ances. AI[ improvements approved by Lcssor, which approvat wiil not <br />be unreasonably withheld, shall be at Lessee's expense and the instaUation of all <br />improvements shall bc at the discretion and option of the Lessee. Lessee shall <br />have the right to replace, repair, add or otherwise modify its equipment or nny <br />portion thereof, whether the eq�ipment is specified or not on any e.chibit altached <br />hereto, during the term �f this figreement. Notwithstanding anything herein to <br />the contrary, Less�r approval will not be required for like-kind equipment <br />changes or minor, routine repairs, alterations or modifications to the <br />communications faciiity. Lessee witl maintain the Premises in a good condition <br />reasonable wear and tear excepted. Lessor will maintain the Property, cxcludin� <br />the Premises, in good condition, reasonabie wear and lear excepted. <br />7. Ass�ment. The following provision shail be subs�tituted for in its entirety and <br />rep�ace the secQnd paragraph in Article 6.02 of the Agreement: <br />This Agreement Fnay be sold, assigned or transferred by Lessee without any <br />approvat or co�sent ofLessor to Lessee's principal, afflia#es, subsidiaries af its <br />principal or to any entity which acquires all or substantia[ly all of Lessee's assets <br />in the market defined by the rederal Cammunications Commission in which the <br />Property is located hy reason of a merger, acquisition or other business <br />rcorganizatipn.
