CSR-Associated shall complete reclamation of the Transfer Lots in accordance with the amended <br /> DNR surface mining permit, which shall conform to the City's Technical Acceptance Standards, <br /> attached hereto as Exhibit C. CSR-Associated also agrees to provide rough grade for the <br /> Transfer Lots in accordance with City specifications in the Technical Acceptance Standards. <br /> (h) Roads. CSR-Associated and the City shall jointly develop an"Interim <br /> Access Plan"prior to the transfer of Lot 45-A and a"Final Access Plan,"providing for access to <br /> and use of Lots 45-A, 45-B and 45-C, prior to the completion of the frontage improvements <br /> described in Subsection 1.6(k). <br /> (1) Slopes. For a period of three (3) years after conveyance of the final <br /> Transfer Lot, i.e., Lot 45-C, CSR-Associated expressly warrants the surface and subsurface <br /> stability of all slopes on the Transfer Lots. CSR-Associated shall not be responsible for sloughs <br /> or failures due to actions of the City or members of the public. CSR-Associated shall provide <br /> reasonable maintenance of the slopes of the Transfer Lots for the duration of this warranty <br /> period. Reasonable maintenance shall include repair of sloughing or slope failures. CSR- <br /> Associated shall not be responsible for ordinary vegetation management and/or landscaping. <br /> CSR-Associated shall expressly warrant the surface and subsurface stability of any slope repairs <br /> for an additional five years. <br /> (j) Utilities. For the purpose of serving the Transfer Lots, CSR-Associated <br /> agrees to extend public water supply utilities, at its own expense, through the Sievers-Duecy <br /> Boulevard right of way no later than July 15, 2000 and provide sewer service at the time frontage <br /> improvements are provided, unless such deadlines are otherwise extended by agreement <br /> S:\GDoughty\W IN WORD\CSR\AgreementFinal.doc 14 <br /> Seattle/2.8.00 <br />
