'. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Everett that: Section 1: It does hereby adopt the Hearing Examiner's Findings, Conclusions and Recommendation dated October 15, 1999, hereinafter referred to as "Recommendation"which is attached hereto and incorporated herein by reference as Exhibit"A". Section 2: It does hereby approve the parking reduction of ten percent. Section 3: It declares its intent to rezone property the legal description of which is: Plat of Everett Division `K', Block 363, Lots 17-18 from R-2 (Single Family Medium Density) to B-2 (Community Business),pursuant to the provisions of Section 41.160 of Ordinance 1671-89, as amended, and the Council shall by Ordinance, effect such rezone upon being advised that all of the conditions set forth in the Recommendation in Exhibit A have been met. Section 4: Expiration of this Approval- If all improvements required herein are not completed in full compliance with the terms of this Resolution within five (5) years of the date of City Council approval, this Resolution shall become null and void. In the event that this Resolution becomes null and void, development of the site shall be subject to the requirements of the R-2 Single Family Medium Density zone and all regulations in effect at the time of application for permits. Section 5: Use of Property Inconsistent with this Resolution-If any use of the herein described property is inconsistent with the terms of this Resolution, either before, during or after construction and installation of all improvements required by the Resolution, then this Resolution shall become void and all entitlements to the uses permitted herein shall be forfeited, and any use inconsistent with the underlying zoning of the property shall be deemed a violation of the zoning code and be subject to violation, enforcement, and penalty provisions thereof. Section 6: Resolution- A copy of this Resolution shall be recorded with the Snohomish County Auditor's Office.
