'. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Everett that: <br /> Section 1: It does hereby adopt the Hearing Examiner's Findings, Conclusions and <br /> Recommendation dated October 15, 1999, hereinafter referred to as "Recommendation"which is <br /> attached hereto and incorporated herein by reference as Exhibit"A". <br /> Section 2: It does hereby approve the parking reduction of ten percent. <br /> Section 3: It declares its intent to rezone property the legal description of which is: <br /> Plat of Everett Division `K', Block 363, Lots 17-18 <br /> from R-2 (Single Family Medium Density) to B-2 (Community Business),pursuant to the <br /> provisions of Section 41.160 of Ordinance 1671-89, as amended, and the Council shall by <br /> Ordinance, effect such rezone upon being advised that all of the conditions set forth in the <br /> Recommendation in Exhibit A have been met. <br /> Section 4: Expiration of this Approval- If all improvements required herein are not completed <br /> in full compliance with the terms of this Resolution within five (5) years of the date of City <br /> Council approval, this Resolution shall become null and void. In the event that this Resolution <br /> becomes null and void, development of the site shall be subject to the requirements of the R-2 <br /> Single Family Medium Density zone and all regulations in effect at the time of application for <br /> permits. <br /> Section 5: Use of Property Inconsistent with this Resolution-If any use of the herein described <br /> property is inconsistent with the terms of this Resolution, either before, during or after <br /> construction and installation of all improvements required by the Resolution, then this <br /> Resolution shall become void and all entitlements to the uses permitted herein shall be forfeited, <br /> and any use inconsistent with the underlying zoning of the property shall be deemed a violation <br /> of the zoning code and be subject to violation, enforcement, and penalty provisions thereof. <br /> Section 6: Resolution- A copy of this Resolution shall be recorded with the Snohomish County <br /> Auditor's Office.
