<br /> 15. Indemnification. Tenant shall indemnify, defend, and hold Landlord harmless from
<br /> any and all claims arising from Tenant's use of the Premises, Building or Common Areas,
<br /> or from any act, omission, or negligence of Tenant, or that of its agents, employees,
<br /> sublessees, invitees or licensees in or about the Premises, Building or Common Areas.
<br /> Tenant shall not be obligated to indemnify Landlord for the portion of any claim or liability
<br /> caused by or arising from the act, omission or negligence of any party other than Tenant,
<br /> or its agents, employees, sublessees, invitees or licensees. Tenant also shall indemnify,
<br /> defend and hold Landlord harmless from all costs, attorneys'fees, expenses and liabilities
<br /> incurred in connection with any claim or proceeding for which Tenant is responsible
<br /> hereunder.
<br /> Landlord shall indemnify and hold Tenant harmless from any and all claims arising
<br /> from any act, omission or negligence of Landlord, or that of its agents, employees,
<br /> invitees or licensees in or about the Premises, Building or Common Areas. Landlord shall
<br /> not be obligated to indemnify Tenant for the portion of any claim or liability caused by or
<br /> arising from the act, omission or negligence of the Tenant, its agents, employees,
<br /> sublessees, invitees or licensees. Landlord also shall indemnify, defend and hold Tenant
<br /> harmless from all costs, attorneys' fees, expenses and liabilities incurred in connection
<br /> with any claim or proceeding for which Landlord is responsible hereunder.
<br /> 16. Insurance.
<br /> (a) Tenant's Insurance. Tenant shall, at its sole cost and expense, keep in full
<br /> force and effect the following insurance:
<br /> (i) Standard form property insurance insuring against the perils of fire,
<br /> extended coverage, vandalism, malicious mischief, special extended coverage
<br /> ("All-Risk") and sprinkler leakage. This insurance policy shall be upon all of
<br /> "Tenant's Property" which is located in the Building or Common Areas in an
<br /> amount not less than ninety percent (90%) of the full replacement cost thereof.
<br /> This insurance policy shall also be upon direct or indirect loss of Tenant's earnings
<br /> attributable to Tenant's inability to use fully or obtain access to the Premises or
<br /> Building in an amount as will properly reimburse Tenant. Such policy shall name
<br /> Landlord and any Mortgagees of Landlord as loss payees, as their respective
<br /> interests may appear for any loss of income by Tenant which impacts the Tenant's
<br /> ability to pay Rent. "Tenants Property" is defined to be all personal property of
<br /> Tenant located in or on the Premises, Common Areas or Building.
<br /> (ii) Comprehensive General Liability Insurance including automobile
<br /> liability insuring Tenant against any liability arising out of the lease, use, occupancy
<br /> or maintenance of the Premises and all areas appurtenant thereto. Such insurance
<br /> shall be in the amount of at least $5,000,000 Combined Single Limit for injury to, or
<br /> death of one or more persons in an occurrence. The Policy shall insure the
<br /> hazards of the Premises and Tenant's operations thereon, independent
<br /> contractors, and contractual liability (covering the indemnity contained in Section
<br /> 8
